GOVERNMENT OF INDIA MINISTRY OF COMMERCE DIRECTORATE GENERAL OF FOREIGN TRADE POL CIR NO. 09/(RE-99)/1998-2000 DT 27-05-1999 ALL LICENSING AUTHORITY ALL COMMISSIONERS OF CUSTOMS Sub: Clarification on various provisions of Handbook (Vol.1). 1. Classification of sarees/dhoties/lungies in the DEPB scheme. Representations have been received from the individual exporters as well as Synthetic and Rayon Textiles Export Promotion Council regarding classification of sarees/dhoties/lungies in textile group under DEPB scheme. The matter has been examined and it has been decided that unhemmed and or unstiched sarees/ dhoties/ lungies are classifiable as fabrics whereas hemmed and or stiched sarees/dhoties/lungies are classifiable as madeups under the DEPB scheme. 2. Provisions of paragraph 7.6 of Handbook (Vol.1). The aforesaid paragraph prescribes for issuance of duty free to the newcomer only against confirmed irrevocable Letter of Credit. Since in respect of domestic supplies against Advance Intermediate Licence and Special Imprest Licence, where payment is received through normal banking channel or through project authorities, the condition of confirmed irrevocable Letter of Credit as mentioned in paragraph 7.6 shall not be applicable in respect of above two categories of duty free licences. 3. Validity of licences for sourcing of goods from private bonded warehouse in terms of paragraph 4.23 of the Handbook (Vol.1). Representations have been received from individual exporters on the aforesaid issue. The matter has been examined and It is clarified that in case of sourcing of goods from private bonded warehouse, the licence should be valid on the date of clearance of such goods from bonded warehouse. The licence may not be valid on the date on which the goods are imported by private bonded warehouse for warehousing such goods. 4. Paragraph 12.15 of the Handbook (Vol.1) relating to golden status certificate. It is clarified that in cases where the eligible applicant has obtained different categories of status for three successive terms or more , the golden status shall be issued according to the last status obtained by him in the three successive terms.
