Exim Policy - DES/ PassBook Scheme/ EPCG Scheme - Kar Vivad Samadhan Scheme - DGFT - 17/(RE-99)/1999-2000Extract Exim Policy - DES/ PassBook Scheme/ EPCG Scheme - Kar Vivad Samadhan Scheme GOVERNMENT OF INDIA MINISTRY OF COMMERCE DIRECTORATE GENERAL OF FOREIGN TRADE POL CIR NO. 17/(RE-99)/1999-2000 Dated 06-7-99 Clarification relating to settlement of cases of Duty Exemption scheme/ Pass Book Scheme under Kar Vivad Samadhan Scheme Rules, 1998 of Ministry of Finance. A clarification has been sought whether Kar Vivad Samadhan Scheme is applicable to various Export Promotion Scheme like Duty Exemption Scheme / Pass Book Scheme/EPCG Scheme. The matter has been examined in consultation with the Department of Revenue. It is hereby clarified that if the licence holder settles the custom dues and payable under the Kar Vivad Samadhan Scheme, he can only be absolved of his liability in relation to the Customs Duty due and payable. The licence holder is also entitled for grant of immunity from prosecution under the provision the Customs Act, 1962. However, the licence holder is not entitled to claim any benefit in respect of actions that may be initiated by the DGFT for any violation under the Foreign Trade (Development and Regulation) Act, 1992, Rules and orders made thereunder including regularization procedure laid down in the Exim Policy and Handbook of Procedures (Vol. 1).
