Consideration of application for grant of EPCG Scheme Licence to Hotel Industry, units under Textile and Garment sector - DGFT - 52(RE-99)/1997-2000Extract Consideration of application for grant of EPCG Scheme Licence to Hotel Industry, units under Textile and Garment sector GOVERNMENT OF INDIA MINISTRY OF COMMERCE DIRECTORATE GENERAL OF FOREIGN TRADE POLICY CIRCULAR NO.52(RE-99)/1997-2000 Dated: 18/02/2000 Subject:- Consideration of application for grant of EPCG Scheme Licence to Hotel Industry, units under Textile and Garment sector. Attention is invited to Paragraph 6.2 of the Current Exim Policy, 1997-2000 which provides for Zero Duty import under EPCG Scheme in case for value is Rs.1 crore or for Textile sector interalia. The said facility is also available to Hotels, tour operators or tourist transport operators who are recognized as Export House trading House/Star Trading House and Super star Trading House or Service Export House, International Service, Export House, International Star Service Export House, International Super Star Service Export Houses. - Accordingly to Ministry of Commerce, Public Notice No 33(RE-99) 1997-2002,dated 1.10.99,EPCG applications may be made to the concerned Regional licensing authority for obtaining a licence on the basis of a self declaration subject to final fixation of nexus by the Headquarters EPCG Committee and with an understanding that in case the Hqrs. EPCG-disallows any capital goods, the licence holder shall be liable to pay the Customs Duty with 24% interest on such goods. , It has been brought to the notice that the RLAs are not adhering to a uniform Policy with regards to issue of EPCG licences to the Hotel Industry, Textile Sector and Garment Sector. With a view to maintaining a uniform Policy and removing ambiguity in this regard, it is clarified that:- i) For Hotel Industry, the licences will be issued only for the items, covered b: the Customs Notification No. 60/98 Customs, dated 3.8.98 and 31/99-Customs, dated 8.3.99 (Annexure 1). ii) For Textiles sector, the licence will be issued only for the items, covered by the Customs Notification No 121/99-customs, dated 4.11.99 (Annexure 11). iii). For the Garments sector, the licence will be issued for the items listed in Annexure III. In respect of applications, for import of the items covered by the lists give in Annexure I , II, and III above for such sectors, licences under Zero Duty as well as 10% duty can be issued by the concerned RLAs within their financial limit without referring such applications to the Headquarters. Application for import of any items which are not covered by these lists may be referred to Hqrs. EPCG Committee for consideration in terms of the said Public Notice No.33/[RE-99]/1997-2002 dated 1.10.99. This issues with the approval of Directorate General of Foreign Trade.
