Cinematograph Films and Other (including film on Video tape, Compact Video disc, Laser Video discs or Digital Video discs) Import Policy Public Notification No. 4(PN)/97-02 dated the 31st March, 1997 Sub: Export and Import Policy for April, 1997 -March, 2002 -Policy for import Cinematograph Films and Other (including film on Video tape, Compact Video disc, Laser Video discs or Digital Video discs). In exercise of the powers conferred under Paragraph 4,11 of the Export and Import Policy, 1997-2002 and in supersession of Public Notice No. 38/(PN)/92-97 dated the 12th August, 1992 and as amended from time to time, Director General of Foreign Trade hereby notifies the policy for the Import of cinematograph films and Other (including film on Video tape, Compact Video disc, Laser Video discs or Digital Video discs) effective from 1.4.1997, as under:- (i) Imports, of cinematograph feature films and Other (including film on Video tape, Compact Video disc, Laser Video discs or Digital Video discs) may be made without a licence by the National Film Archive of India, Film and Television Institute of India, National Centre of Films for Children Young People and Directorate of Film Festivals Satyajit Ray Film Television Institute. (ii) Import of cinematograph feature films and Other (including film on Video tape, Compact Video disc, Laser Video discs or Digital Video discs) may be made without a licence by other importers also, provided the importer has obtained from the Administrative Officer Central Board of Film Certification or any other officer designated for the purpose by the Ministry of Information and Broadcasting, a certificate to the effect that the film has :-- (a) won an award in any, of the International Film Festivals notified by the Ministry of Information and Broadcasting, Government of India; or (b) participated in any of the official sections of the notified International film Festivals; or (c) received good reviews In prestigious film Journals notified by the Ministry of Information and Broadcasting, Government of India. The list of International Film Festivals and prestigious film journals presently notified by the Ministry of Information and Broadcasting, Government of India are given in the Annexure. The, list may be modified by that Ministry from time to time. (iii) The importer of the film shall comply with the provisions of all applicable Indian laws governing the distribution and exhibition of films, including the requirement of obtaining a certificate of public exhibition prescribed under the Cinematograph Act, 1952. (iv) Import of any unauthorised/pirated films shall be prohibited. (v) Import of foreign reprints of Indian films shall not be permitted without the prior permission in writing from the Ministry of Information Broadcasting, Government of India. (vi) The Ministry of Information Broadcasting, Government of India, on being satisfied that it is necessary expedient in public interest to do so, may waive or relax the above requirements, (vii) These provisions shall remain valid upto 31st March, 2002, unless otherwise amended.
