Sandalwood chips export allowed against licence - DGFT - 26 (RE-97)1997-2002Extract Sandalwood chips export allowed against licence Public Notice No.26(RE-97)1997-2002 dated the 14th July, 1997 Unutilised certificates of 1995 and Unlifted stocks in past to be also considered Attention is invited to the Ministry of Commerce Notification No. 8/1997-2002 dated 14th July, 1997 according to which the entry appearing at S.No. 9 in Chapter 16, Negative List of Exports, Part I, Paragraph 16.1- prohibited items of the Export Import Policy, 1997-2002, has been amended. Attention is also invited to the entry at SI. No.32 of Paragraph 16.2- Restricted items (Exports Permitted Under Licence) of the Export Import Policy 1997-2002. 2. In exercise of the powers conferred under Paragraph 4.11 of the Export Import Policy 1997-2002, the Director General of Foreign Trade hereby specifies the conditions and procedures to be followed in respect of the export of sandalwood in the form of heartwood chips (upto 50 gms), mixed chips (upto 30 gms). flakes (upto 20 gms) of the sandalwood classes mentioned in Annexure I to this Public Notice, sandalwood sapwood chips/powder and sandalwood dust obtained as waste after the manufacturing process. 3. All such exports shall be permitted only against an Export Licence to be issued by the Directorate General of Foreign Trade. 4. Applications for grant of Export Licence may be made in the form given in Appendix 18A not later than 31st July, 1997 to the Director General of Foreign Trade. It shall be accompanied by a copy of the valid Export Order/Irrevocable Letter of Credit from the foreign buyer, a copy of the valid RCMC, a copy of I.E. Code Number and Certificate(s) of Origin/Certificate(s) of Legal Procurement from the Principal Chief Conservator of Forests of the concerned State from where the sandalwood has been procured in the format as prescribed at Annexure II to this Public Notice. The unutilised Certificate(s) of Origin that were furnished to Directorate General of Foreign Trade with reference to Public Notice No.75-ETC (PN)/92-97 dated 8th December 1995 shall also be considered for issue of Export Licence. In case of unlifted stocks of State Government Forest Departments auctions, Legal Procurement Certificate(s) in the Format prescribed at Annexure II without entries at SI. No.8 9 shall also be considered for issue of Export Licence. However in such cases, the exporters shall be required to furnish the said details from the Principal Chief Conservator of Forests of the concerned States alongwith physical verification of stocks within 60 days of provisional allocation falling which their provisional allocation failing which their provisional allocation will be cancelled. Further the Sandalwood stocks must have been purchased directly by the exporter/applicant in the auctions of the State Government and that the Certificate(s) of Origin and the Legal Procurement Certificate(s) must have been issued directly in the name of exporter/ applicant by the Principal Chief Conservator of Forests of the State concerned from where the stocks have been purchased. 5. The Export Licensing committee at the Headquarters may consider such applications on merits for issue of Export Licences which shall be subject to any condition as may be prescribed from time to time including the conditions of: - a. Quantitative Ceilings; b. Minimum Export Price; c. Size/weight stipulations in respect of heartwood chips not exceeding 50 gms. , mixed chips not exceeding 30 gms. and flakes not exceeding 20 gms. of the sandalwood classes mentioned in Annexure I to this public notice. 6. Sandalwood dust, obtained as waste after the manufacturing process, may be permitted for export under licence by manufacturer exporters of value added sandalwood handicrafts products and machine finished goods subject to a quantitative ceiling and such other conditions as may be prescribed. 7. The export licence shall be issued by the Directorate General of Foreign Trade only when the firm produces a certificate of physical verification of stock from the Regional Deputy Director Wild Life In case of Delhi/Bombay/Calcutta/Madras or from the Divisional/District Forest Officer or Deputy Conservator of Forests of the concerned territorial division. Before issue of export licence, the exporter shall also be required to furnish Certificate(s) of Origin/legal Procurement Certificate(s) in the format prescribed at Annexure II issued by the Principal Chief Conservator of Forests in original to the Directorate General of Foreign Trade for endorsement. 8. Export of sandalwood in the forms as specified above against licences issued during the licensing year 199.7-98 shall be completed by 31st December,1997. Provisions of paragraphs 1.4 and 1.5 of the Export Import policy, 1997 -2002 shall not be applicable to such exports. Sd/- (S.B.
