Amendments in Handbook of Procedures (Vol. I) - DGFT - 84 /2005Extract Amendments in Handbook of Procedures (Vol. I) PUBLIC NOTICE NO. 84/2005 Dated 23/01/2006 In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy 2004-2009, the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures, Vol.I: 1. At the end of the first sub-paragraph of Paragraph 4.4.3, the following sentence shall be added:- "Further, duty free import of spices ( covered by chapter 9 of the ITC (HS) Classifications of Export Import Items, 2004-09) for export under advance licence scheme shall be permitted only for value addition purposes like crushing/grounding/sterilization or for manufacture of oils and oleoresins and not for simple cleaning, grading, re-packing etc". 2. At the end of paragraph 4.7, the following sentence shall be added:- "Further, duty free import of spices (covered by chapter 9 of the ITC (HS) Classifications of Export Import Items, 2004-09) for export under advance licence scheme shall be permitted only for value addition purposes like crushing/grounding/sterilization or for manufacture of oils and oleoresins and not for simple cleaning, grading, re-packing etc". 3. At the end of the first sub-paragraph of Paragraph 4.22, the following sentence shall be added: "In case of Spices ( covered by chapter 9 of the ITC (HS) Classifications of Export Import Items, 2004-09), the export obligation shall be fulfilled within a period of 90 days from the date of receipt of the first import consignment i.e. the date on which the first import consignment is cleared by the customs authorities against the licence". 4. At the end of para 6.7(c), the following shall be added:- "Similarly, export obligation against import of (covered by chapter 9 of the ITC (HS) Classifications of Export Import Items, 2004-09) shall be fulfilled within a period of 90 days from the date of receipt of the first import consignment i.e. the date on which the first import consignment is cleared by the customs authorities". 5. In Appendix 14-I-C "Sector specific requirements for EOU/SEZ Units", after Sl. No. 9, the following shall be added:- "10. Spices ( covered by chapter 9 of the ITC (HS) Classifications of Export Import Items, 2004-09) (i) Duty free import of spices for export shall be permitted only for value addition purposes like crushing/grounding/sterilization or for manufacture of oils and oleoresins and not for simple cleaning, grading, re-packing etc. (ii) A minimum value addition of 15% shall have to be fulfilled".
