Export of Rice (Basmati and Non-Basmati) to Iran - Indian Laws - TRADE NOTICEExtract Agricultural and Processed Food Products Export Development Authoity (APEDA) (Ministry of Commerce Industry, Government of India) June 1 7, 2014 TRADE NOTICE Export of Rice (Basmati and Non-Basmati) to Iran 1. Government of Islamic Republic of Iran, Food and Drug Administration Food Products and Beverages Assessment Department General have issued Executive Instructions for Source Registration Method, Issue Health Permit for Imports, Importing Permit, Rice Discharge vide Code: FB-Pr-1392-002 dated December 18, 2013. The import of rice into Iran w.e.f. March 21, 2014 would be monitored in accordance with these Executive Instructions. 2. The details of documents to be provided by the import applicants for source registration of foreign rice processing and packaging factories as provided in para 5 of the Executive Instructions is given in Annexure I for guidance of the exporters of rice from India to Iran for facilitating their registration as source. 3. Details of certificates /documents required for issue of Import and Clearance Permit as provided in para 7 of the Executive Instructions is given in Annexure II. 4. Ministry of Commerce Industry, Government of India vide Office Memorandum F.No.6/2/2014-EP(Agri.IV) dated June 13, 2014 has nominated APEDA as Competent Authority to issue a consolidated certificate covering the following requirements: i) Health Certificate ii GMO Free Certificate iii) Phenol Residual Free Certificate iv) Adaptation of Heavy Metal and Mycotoxin Certificate accompanied by details of test result in accordance with the Revised National standards of Iran under No.13120. 5. Exporters of rice from India to Iran are required to submit samples of rice from export consignments for testing to one of the laboratories recognised /approved by APEDA. The list of recognised / approved laboratories is given in Annexure III. 6. Exporters will submit an application to APEDA for obtaining certificate as per para 4 above in the format provided at Annexure IV with a payment of ₹ 2000/-per consignment/certificate. The payment will be made in favour of APEDA by Demand Draft. Certificate will be issued by APEDA as per format given in Annexure V. 7. In case of export of Basmati rice, contracts of export will be registered by the exporter with APEDA in accordance with Trade Notice dated July 5, 2012 as amended from time to time. Santosh Sarangi Chairman Secretary Annexure I Documents to be provided with import application for source registration (Para 5 of Executive Instructions Para No. Certificate/document To be provided by 5.1 Written application of the applicant company Format in Attachment-I of the Executive Instructions 5.2 Completed check-list of application for issuance of import health permit Format in Attachment-II of the Executive Instructions 5.3 Articles of Association of the company To be provided by the importer 5.4 Documents of Plant and Product Master File To be provided by production factory as per Attachment-III of the Executive Instructions 5.5 Certificate issued by the Legal Competent Authorities of the country of origin including confirming health and safety of rice, health and technical conditions of processing and packaging factory, permission for exports to the other countries from the country of origin To be provided by the Producing Unit 5.6 One of the Food Safety Certifications approved by an authentic accreditation body which is sealed by the Embassy of the Islamic Republic of Iran (ISO 22000:2005/HACCP/IFS/BRC If none of these certifications is possessed, factory can be inspected by Inspection Team of Food and Drug Administration 5.7 Free Sale original certificate issued by the Competent Public Organisations, sealed by Embassy of Islamic Republic of Iran Beside the exporting Public Organisations the certificate may be issued by the Production Factory approved by the Competent Public Authorities and sealed by Embassy of the Islamic Republic of Iran 5.8 Certificate of the Operation of Agency issued by Ministry of Commerce or Commercial Registration of the Product To be supplied in Iran by the importing company 5.9 Product Analysis Certificate To be provided by the producing Unit as per the latest requirements of the rice quality and health specifications 5.10 Notarised undertaking for ensuring health of the imported rice To be provided by the importer as per Format at Attachment-IV of the Executive Instructions 5.11 Two copies of the Persian label 5.12 Copies of receipt for product and source registration paid To be provided by the Importer In case of application by another company for registration of the product in a different brand from the source already registered, submission of documents 5.4,5.5 and 5.6 is exempted. Note-8: It is required to insert the specifications mentioned in paragraph 5.11, tracking code of the product, and production series on the packages from the Country of Origin and the Cargos without specifications may not be cleared from the customs.
