Appointment of custodian of import and export cargo at ICD, Jamshedpur - Customs - 4/2002Extract Public Notice No. 4/2002 Dated 25/02/2002 In exercise of the powers conferred upon me under Sec. 45(1) of the Customs Act, 1962 I, B.R. Tripathi, Commissioner of Central Excise Customs, Jamshedpur hereby appoint M/s. Container Corporation of India Ltd., Eastern Region, Kolkata (A Govt. of India Undertaking) to be the custodian of imported goods received in containers at ICD, Jamshedpur and /or transhipped to ICD, Jamshedpur until these are cleared for home consumption or are warehoused or are transhipped in accordance with the provisions of Chapter VIII of the Customs Act, 1962 . Similarly, M/s Container Corporation of India Ltd., Kolkata will also be the custodian of export cargo brought into ICD, Jamshedpur for stuffing, accountal, Customs Examination, Transportation and safe delivery of the customs sealed containers at the Gateway Port for onward shipment. M/s Container Corporation of India Ltd. as the custodian of goods meant for Export and Import would be required to comply with the provisions of Sec. 45(2) of the Customs Act, 1962 as well as the rules, regulations and instructions issued from time to time on the subject mentioned above. If any imported goods are pilfered or lost after unloading in the Customs are while in the custody of the Custodian, then in terms of Sec. 45(3) of the Customs Act, 1962 , then M/s Container Corporation of India shall be liable to pay duty on such goods at the rate prevailing on the date of delivery of any import manifest, or as the case may be, an import report, to the proper officer under Sec. 30 for the arrival of the conveyance in which the said goods were carried. This appointment shall initially remain for 5 years and subject to the satisfaction of the 1 [Principal Commissioner or Commissioner]. The Commissioner shall have the right to terminate this appointment at any time after assigning specific reasons and giving an opportunity for the custodian to explain his case. The appointment shall be reviewed after every five years thereafter. All Trade Associations/Chambers of Commerce/Members of RAC (Both organised and SSI) falling within the jurisdiction of Commissionerate of Central excise Customs, Jamshedpur are requested to bring the contents of this Public Notice to the notice of their constituent Members and others concerned. ------------------------- 1 Substituted by Notification No. 56/2014 Cus (N.T.), dated 06/08/2014
