Registration of Contract for assessment under CTH 98.01 - Customs - 17/2011Extract OFFICE OF THE COMMISSIONER OF CUSTOMS (IMPORT) NEW CUSTOM HOUSE, BALLARD ESTATE, MUMBAI-400001 F.NO: S/26-Misc-10/2011CC Date: 22-03-2011 PUBLIC NOTICE No.17/2011 Sub: Registration of Contract for assessment under CTH 98.01 Attention of importers, Custom House Agents and all other concerned is invited to PN No. 154/29-11-1989 on the above subject. It is noticed that there is prolonged delay in submission of the reconciliation statement after the completion of the last importation. As per Regulation 7 of Project Import Regulation,1986 (PIR, 1986) for finalization of contract, the importer shall submit within three months from the date of clearances for home consumption of the last consignment of the goods or within such extended period as the proper officer may allow to submit a statement indicating the details of the goods imported together with necessary documents as proof regarding the value and quantity of goods so imported in terms of this Regulation and any other document which may be required by the proper officer for finalization of the contract. It is therefore, decided that henceforth projects will be registered for a specific period during which imports of a particular project are to be completed. Reconciliation Statements and Plant Site Verification Report alongwith other required documents should be submitted within three months from the expiry of this period. The application for registration of Contract given as Proforma-A to PN No. 154/29-11-1989 is suitably amended from Sr. No. 18. The amended Annexure-A is enclosed with this Public Notice. Henceforth the amended Annexure-A shall be submitted for registration of Contract for assessment under CTH 98.01. 2. It is noticed that after registration of the Contract, the Department is not able to monitor the progress of imports, installation of the goods imported and the completion of the Project. It is therefore, decided that henceforth the beneficiaries under the Project Import Regulation, 1986 are required to submit a Quarterly Report regarding progress of the Project, and expected date of completion of imports and installation of goods imported availing benefit of PIR, 1986. This Quarterly Progress Report should be submitted in the format enclosed as Annexure-1 to this Public Notice along with self certified copies of Bills of Entry. Submission of Quarterly Report will not only ensure better monitoring of imports under a registered Contract but also enable the department to point out shortcomings in the documents so as to ensure timely finalization of the projects. This is applicable to all the importers who have already registered their Contract for import under CTH 98.01. The Quarter for the Contract shall be calculated from April of every financial year irrespective of the date of registration of the contract. To illustrate, the first quarterly report shall be submitted for further period from January 2011 to March, 2011 in the first week of April, 2011. The last date for submission of this quarterly report shall be within seven days of the month succeeding the quarter. If there are no imports in that quarter, then also this report is required to be submitted as NIL report. 3. In case of repeated failure in the submission of Quarterly Progress Report on part of the importer, the Department may consider de-registration of the Project registered. Sd/- (S. H.
