Amendment to instructions contained in Public Notice No. 100/2010 dated 07.10.2010 and Public Notice No. 02/2011 dated 05.01.2011 reg. - Customs - 40/2011

Attention of the Exporters, CHAs and Trade is invited to Public Notice No. 100/2010 dated 07.10.2010 and Public Notice No. 02/2011 dated 05.01.2011. The Annexure C annexed to the Public Notice No. 100/2010 and Public Notice No. 02/2011 contains instructions to be followed by the officials supervising the factory stuffing of export goods in the factory. 2. At para 8(ix) of the Annexure C of the Public Notice No. 100/2010 and Para 2(ix) of the Public Notice No. 02/2011 instructions are given that whenever the goods are exported under Advance Licence / DEEC Scheme, Chartered Engineers Certificate is to be verified to the effect that the goods under Export are manufactured out of exempt materials as per SION norms. If this instruction is not followed properly, assessment will be made provisionally. 3. Representations have been received from the Exporters Exporters Associations stating that they are facing difficulties to the extent that time is wasted and additional expenses are incurred in obtaining the Chartered Engineers Certificate for each and every export consignment. Moreover, the Chartered Engineers Certificate is already being submitted along with their applications at the time of fixation of standard input output norms (SION). 4. The issue has been re-examined and it has been decided to delete Para 8(ix) of the Annexure C annexed to the Public Notice No. 100/2010 dated 07.10.2010 and Para 2(ix) of the Public Notice No. 02/2011 dated 05.01.2011. However, it is clarified that whenever necessary, the sealed sample brought alongwith the goods may be sent for test. In case of recognized exporters, as per Public Notice No.17/2009 dated 21.04.2009, the inhouse Test Report would be accepted. 5. Public Notice No. 100/2010 dated 07.10.2010 and Public Notice No. 02/2011 dated 05.01.2011 stands modified to the above extent, all other conditions remaining the same.
