The DGFT in its aforesaid communication had stated that the above exemption is available to import of new capital goods under SHIS Scheme as the primary purpose of this scheme is upgradation of technology. 2. The issue was taken up for further examination with DGFT. DGFT vide OM F. No. 01/61/180/49/AM14/PC-3/(part) dated 13.06.2018, has informed that the FTP/HBP pertaining to the SHIS Scheme did not specifically bar import of second hand capital goods. In absence of any legal backup under the provisions of FTP/HBP to deny import of second hand capital goods under SHIS Scrips, the aforesaid clarification dated 28.04.2014 has been withdrawn by DGFT . 3.
