No. S/20-105/2015/AG Dated 08.12.2015 PUBLIC NOTICE No.26/2015 Sub: Permission granted for Import/Export of all permissible goods from Adani Kandla Bulk Terminal Pvt. Ltd., located near Tuna, off Tekra, outside Kandla Creek, Kandla Port Attention of all Importers, Exporters, Customs Brokers, Shipping Lines/Agents and the members of Trade and Industries is invited to the below mentioned Customs Notifications relating to the Import/ Export of goods under various Export Promotion Schemes: (i) Notification No.16/2015 -Customs dated 01.04.2015 -related to Export Promotion Capital Goods (EPCG) Scheme. (ii) Notification No.18/2015 -Customs dated 01.04.2015 -related to Advance Authorisation Scheme. (iii) Notification No.19/2015 -Customs dated 01.04.2015 -related to Duty Free Import Authorisation Scheme. 2. Various Sea-Ports, Airports, Inland Container Depots (ICDs) and Land Customs Stations (LCSs) have been notified for Imports and Exports under the aforesaid Export Promotion Schemes in the above referred Notifications. Further, as per Provisos in these Notifications, the Commissioner of Customs has been empowered to permit imports and exports through any other Sea Ports, Airports, Inland Container Depots (ICDs) and Land Customs Stations (LCSs) in his jurisdiction by issuing a special order or a public notice, in this regard, subject to such conditions as may be specified. 3. Though the aforesaid Notifications do not include. Adani Kandla Bulk Terminal Pvt. Ltd.(AKBTPL), Tuna in the list of eligible ports, provisions therein empower the jurisdictional Commissioner to allow Import or/and Export from any other port within his jurisdiction. In view of these enabling provisions, request received from M/s. AKBTPL and to provide Trade Facilitation Measure, it has been decided to permit Import/Export of all permissible goods from Adani Kandla Bulk Terminal Pvt. Ltd., located near Tuna, off Tekra, outside Kandla Creek, Kandla Port under above referred notifications for a period of one year from the date of issue of this Public Notice, subject to the conditions specified below: a. All assessments will be continued to be done in the ICES. No Manual Bill of Entry or Shipping Bill shall be allowed to be filed unless specifically permitted to do so; b. The Bills of Entry and Shipping Bills are assessed by an officer not below the rank of an Assistant/Deputy Commissioner; c. Export consignments will be subject to test weight of container/ packages, on selective basis by the Department; d. Shipping Bills/Bills of Entry should be submitted at least 3 days in advance of Shipping/unloading of Cargo (excluding Saturday/ Sunday/ Gazetted Holidays) at the port clearance; and e. The Importers shall also be required to produce the Release Advice (for the import licence) issued by the Customs Authorities at the Port of registration of the above licences to their counter parts at the Port of Import, in cases where the Port of registration is not the same as the Port of Import. 4. Without prejudice to above, required statutory procedure as prescribed in the Customs Act, 1962 or any other law for time being in force, shall be followed at AKBPTL as being followed at Kandla Port. 5. All the Trade Associations/Chamber of Commerce, Customs Brokers are requested to publicise the contents of the Public Notice among their Members/ Constituents, for their information and necessary action.
