No. VIII/48/136/2017-Cus.Tech Date: 14.03.2018 PUBLIC NOTICE No. 10/2018-Cus. Sub: Customs - Implementation of Electronic Sealing of Containers by exporters under self-sealing procedure - regarding. Attention of all the Importers, Exporters, Customs Brokers, Steamer Agents, Custodians/Customs Cargo Service Providers, Trade Associations/Chamber of Commerce, Members of the RAC/PGC and the Public is invited to the Trade Facilitation Circular No.02/2017, dated 27/12/2017 regarding procedure for grant of self sealing permission to the Exporters in GST regime consequent to CBEC Circular No.26/2017-Customs, dated 01/07/2017 and transfer of Customs functions presently being performed by the Central Tax formations. 2. As per Board's Circular NQ.51/2017-Customs, dated 21/12/2017, the procedure of stuffing under officer supervision will not be available in respect of exports through 15 locations mentioned at para 2(ii) of the said Circular with effect from 01/03/2018 and from 01/04/2018 in respect of other ports / ICDs. 3. As clarified vide Board's Circular No.41 /2017-Customs, dated 30th October, 2017, the procedure of electronic sealing by exporters under self sealing procedure is applicable only to cargo in full container load, sealed at an approved premises, by an entitled exporter. The procedure is not applicable to export of non-containerized cargo or Air cargo or for movement of cargo from CFSs to ICDs/Ports or cargo exported through Land Customs Stations and extant practice in respect of such cargo shall continue. 4. As per para 5.2 of the Board's Circular No.41/2017-Customs, full containers brought to Ports without RFID e-seals shall be taken to a CFS or allowed direct port entry, as the case may be, and will be subject to usual RMS treatment. Similarly, Full Containers Loads arriving at ICDs, but without RFID e-seals, will be subject to usual risk management parameters. Hence, the Exporters who are not entitled or have not opted for self sealing under electronic sealing procedure may export their goods without REID seals and the same will be allowed for export subject to usual RMS treatment. 5. All the members of the Regional Advisory Committee, Trade and Industry Associations and Chamber of Commerce are requested to circulate the Public Notice among their constituent members for information and guidance. 6. Action to be taken in terms of decisions taken in this Public Notice should be considered as standing order for the purpose of officers and staff. (SUDHA KOKA) COMMISSIONER
