No. VIII(48)09/CUS/TECH/MISC-EXP/2018/45677-58 (A) Date: 10.07.2018 INSTRUCTION No. 02/2018 Dated Shillong the 9th July 2018 Subject: Passenger movement from/to Bangladesh - restrictions/prohibitions regarding Indian currency and currency notes Attention of all concerned is brought to Rule 7 of the Baggage Rules 2016 wherein it has been stated that import and export of currency under these rules shall be governed in accordance with the provisions of the Foreign Exchange Management (Export and Import of Currency) Regulations, 2015 and the notifications issued thereunder. There has been information received at this end that there are passengers arriving at Land Customs Stations in this Commissionerate from Bangladesh who bring with them Indian currency notes while coming into India. In this connection, it may be noted that Regulation 3 of the Foreign Exchange Management (Export and Import of Currency) Regulations, 2015 provides for the Export and Import of Indian currency and currency notes, and sub-regulation (2) of Regulation 3 of the said Regulations clearly indicates that persons who are citizens of Bangladesh and Pakistan are not allowed to import any Indian currency while entering India. Further, RBI A.P. (DIR Series) Circular No. 45/2015- dated 04.02.16 at Para 2A(b)(ii) also states that only persons resident outside India, not being a citizen of Pakistan or Bangladesh and visiting India are allowed to bring into India, Indian currency notes; which clearly shows that citizens of Pakistan or Bangladesh are not permitted to bring in Indian currency while entering India. Similarly, the said Regulations and RBI Circular referred above, also do not allow for the taking out of India, Indian currency currency notes by citizens of Bangladesh Pakistan. In view the preceding, the Customs officials posted at Land Customs Stations in this Commissionerate are directed to ensure strict compliance of the provisions as regards import and export of Indian currency and currency notes so that citizens of Bangladesh or Pakistan do not bring into India or take out of India, Indian currency notes.
