Customs - Transshipment of Export Cargo from Air Cargo Complex, Pune International Airport, Lohegaon, Pune - Customs - PUBLIC NOTICE NO. 03/2018Extract OFFICE OF THE COMMISSIONER OF CUSTOMS GST BHAVAN, 41/A, SASSON ROAD, PUNE-411001 F. No. VIII/Cus/Tech/PN SI/48-75/2016(Part-III) Pune Dated: - 23.01.2018 PUBLIC NOTICE NO. 03/2018 Subject : Customs - Transshipment of Export Cargo from Air Cargo Complex, Pune International Airport, Lohegaon, Pune - reg. Attention of all Airlines/ Importers/ Exporters/ Customs Brokers and the Members of the Trade is drawn to Board's Circular No. 24/2006 - Cus. dated 25.08.2006, 06/2007 - cus. dated 22.01.2007, 08/2011 - cus. dated 28.01.2011 and Trade Facility Notice No. 02/2017 -Customs issued under F. No. VIII/Cus/Tech/PN S1/48-75/2016 dated 29.06.2017 by the Commissioner of Customs, Pune. 2. In this regard, it is bring to your notice that the Pune International Airport has commenced Air Cargo Complex (ACC) operation for export of goods/ cargo w.e.f. 29.06.2017 and export business are doing satisfactorily. 3. Representation have been received from Airlines and Freight Forwarders with request to allow Transshipment of Export Cargo on regular basis through Domestic Airlines to other International Airports as there is a business requirement. 4. Therefore, it has been decided to introduce facility of Transshipment of Export Cargo at Air Cargo Complex (ACC), Pune subject to the condition that export cargo tendered at Air Cargo Complex, Pune International Airport, Lohegaon, Pune for export from another Customs Airport it may be done in the following manner: - i) Shipping Bill should be filed at the originating Customs station (ACC, Pune) and Let Export Order should be given by the Customs at the same station. Transshipment Permit (T P) should be prepared by the airlines/carrier and approved by the proper officer of the ACC, Pune. Transshipment Permit (T P) should be sent along with the cargo. Transshipment bond should he debited for the value o/ cargo: ii) On arrival at the gateway airport, the cargo should be taken to the warehouse of the domestic airlines/cus10dian in a clearly identified area. The concerned airlines/custodian warehouse should have double locking arrangement, one key of which will be with the airlines/custodian and [he other with Customs at the gateway airport, for storage of Transshipment cargo. The Customs officers in charge at gateway airport of warehouse should verify the details of the packages with the T P, Airway Bill etc. The domestic airlines may prepare the Cargo Transfer Manifest (CT M) airlines-wise which is certified by' lhe Export Freight Officer (EFO) at gateway Airport; iii) Cargo should be shifted to the Transshipment warehouse in the export terminal of custodian and acknowledgement obtained. No examination Q/ such cargo should normally be done at gateway airport, except on credible intelligence or information; iv) When the aircraft is ready for loading, the airlines should seek permission the Export Freight Officer(EFC)) at gateway Airport for loading. The load plan prepared by the Airlines should be signed by the Airlines, EEC) and the Custodian at gateway Airport; v) Cargo should be loaded in the aircraft under Customs Supervision of gateway Airport; vi) Copy of manifest signed by the Export Freight Officer(EFO) at gateway Airport and Airway Bill along with copy of Shipping Bill should be sent by the Airlines to the originating Customs station (ACC, Pune) within 30 days of Transshipment. Transshipment Bond shall be re-credited at originating Airport (ACC, Pune); vii) In case the Transshipment is by bonded truck, the marks and numbers of the packages shall be verified With the details in the Transshipment Permission and the bonded truck sealed with bottle seal in the presence of the Preventive Officer/Inspector at originating station (ACC, Pune). viii) If transshipment of cargo is also desired at some intermediate Customs airport, carrier/airlines should give advance intimation to intermediary airport. Customs at intermediary airport would supervise the movement of cargo and endorse the same on Transshipment Permit. The concerned airlines/custodian warehouse should have double locking arrangement, one key of which will be with the airlines/custodian and the other with Customs, for storage of transshipment cargo. The loading of such cargo again would be under the supervision of Customs Officer. 5. As the facility of Transshipment of goods from an Air Cargo Location to another Air Cargo Location has been available in ICES 1.5, the said transshipment from Air to Air locations shall be done electronically on the Indian Customs EDI System (ICES) 1.5 application. The Salient features of the procedures to be followed are for below given the familiarization of Airlines [Importers/ Exporters/ Customs Brokers and the Members of the Trade. The following types of transshipment are covered in this Public Notice :- a) Transshipment by Air, where cargo moved from the Air Cargo Complex by Domestic Carriers to Gateway Airport; and from Gateway Port the cargo is transported by International Carriers (by Air) b) Transshipment from Air Cargo Complex by road to Gateway Airport (by Road) 6. The system flow of the ICES 1.5 application and other guidelines are specified in detailed to the Annexure of this Public Notice. 7. For Export transshipment purpose, it is required to submit a separate continuous bond and/ or BG by the Carrier/ Custodian and get it registered in ICES as Transshipment (T P) Bond. The bond amount would be equivalent to total export incentive. The TP Bond and/or BG for export are registered at Enquiry Section in ICES, If already TP bond for import is registered, same may also be utilized. The Carrier/ Custodian providing such Bond and who undertakes responsibility of transshipment is referred to as Transhipper. 8. Transshipment by Air to Air :- After the issue of LEO, the cargo is handed over to the domestic Carriers/ Custodian. The goods are packaged, the Transhipper is required to file Export Transshipment Permit (ET P) Application Request using Service Centre in the format mentioned in Annexure to this Public Notice. The details sought have to be furnished to the Service Centre operator who after making entry in the system would generate the Checklist for the data entry done in the System. The Transhipper would then verify the ckecklist and acknowledge the entry for submission in the system, At the time of submission of ETP request, Flight No. and Date by which the consignment is exported has to be provided. If the consignment is exported under new MAW B No. or HAW B No. this is also to be provided at the time of filing the ETP request. 9. Once the ET P is submitted, the ET P application would be pending with the Customs Officers (Superintendent or AC) of the Air Cargo Complex for approval. The Transhipper has to approach the designated Customs Officer with ETP request and other relevant documents. The Customs Officers of the Air Cargo Complex would verify the ET P application and approve the same in the System. Once TP is approved, ET P Permit gets printed with TP number and bond/ BG debited by the system. The system will also generate the Transshipment permit (4 copies - Customs Copy/ Agency Copy/ Transporter Copy/ Gateway ACC Copy). Based on the copy of the ETP approval permit print, the Customs Officer (Inspector) shall allow the container/ package to pass out of the gate. The approved ET P permit print should accompany the packages which has been moved to Gateway Airport. 10. It is informed that, as soon as, the ETP approved permit is given, the Bond amount and the BG if any, for the ET P shall be debited in the Bond executed at the time of approval. It would be the responsibility of the Transshipper to ensure that the concerned cargo is exported. 11. As soon as the Cargo reaches the Gateway Airport through ET P, after completion of the preventive checks including verification of Marks Nos. of the package and integrity of the seals to rule out tampering if any as the case may be, Allowed for Shipment entry is made in ICES by verifying the particulars to the notice of the System Manager for further action. The following are pre-requisite for Gate-In-Process at Gateway Airport : ETP granted at the Primary Air Cargo Complex/ Air site; Cargo loading report, (Updated Truck and Seal No. details) has been fed into the system by the Inspector at the primary Air Port; Cargo has been physically transported to the Gateway site and received by the custodian at the Gateway Air site, Custodian has presented a signed copy of the list of packages/ packets received line-wise. It is assumed that the custodian will furnish the arrival list of cargo after necessary segregation of cargo. 12. Transshipment by Road The CHA or Exporter can file ET P request for movement of cargo by Road. The CHA who is making the FTP request and authorized for filing Shipping Bills required to be same. The ET P request can be filed through the Service Centre in the form of electronic message over ICEGATE. Bond shall be of the agency, which filing the ET P request. Thus, the agency shall register the Continuity Transit Bond prior to filing the ETP request. As the procedure, the agency need also provide the bank guarantee (BC). Bond and BG registration process will be same as implemented in ICES/ Imports. Bond value for the ET P request equivalent to the sum of export incentive of the items of the SBS. 13. The CHA/ Exporter/ Freight forwarder makes a request to the Customs specifying the movement of cargo by road, in the prescribed format mentioned in the Annexure alongwith Escort Officer Name Designation, if available, otherwise Appraiser/ Superintendent or AC can enter at the processing stage. Based on the request, loading is supervised by the Customs Officer and the ET P No. is assigned by the Customs, consignment is sealed. After then Truck is moved with the FTP permit and ETP Copies of the SBS to the Gateway Airport. At the Gateway Airport, the consignment is presented to the Custodian with relevant documents such as AWB Bill, ETP Permit, SB details etc. The consignment is presented to the Preventive Officer/ Inspector of Customs for verification. If seal intact, the consignment is transferred to Custodian for loading, otherwise, the cargo is examined and LEO is granted. 14. Process at Gateway ACC: On receipt of the ET P information, system automatically generates a message to the Custodian/ s. The Transhipper will be approach the custodian counter with ETP permit and other relevant documents. The custodian will allow the cargo. Then Transhipper/Custodian will approach the designated Customs Officer with ETP and other relevant documents for examination of cargo. The Customs Officer can view the ETP and corresponding SBS. The Officer has to enter the examination report at the TP level or for each SB; and loading permission. On issue of permission, the cargo is moved to the bonded area. 15. Filing of EGM After Allowed for Shipment entry in given in the system, the Airline agent can file EGM at Gateway Airport for the Shipping Bills loaded in the Aircraft at Gateway Port. On filing of the EGM by the airlines, system will record the EGM No. date and Flight No. against each SB (of the ETP).The application will copy the SB particulars with EGM details to the Customs Port of Origin. The Bond and BG are re-credited. 16. Processing of IGST Refund The ETP approval would serve as EGM for the purpose of export benefits. The EP copy print shall be obtained from the Airport/ Air Cargo Complex where the Shipping Bill has been filed and processed. Similarly, as soon as the approval for ETP permit is given, the Shipping Bill shall move to IGST Superintendent queue for IGST Refund processing. 17. If the cargo transshipped under the provisions of the Customs Act, 1962 is not unloaded at the place of destination in India, or if the quantity unloaded is short of the quantity to be unloaded at that destination, and if the failure to unload or the deficiency is not accounted for, then the person-in-charge of the conveyance shall be liable for penal action as per the provisions of Customs Act, 1962. 18.
