Re-export of imported durable containers within the six months from the date of importation - Customs - Public Notice No. 56/2017Extract OFFICE OF THE PRINCIPAL COMMISSIONER OF CUSTOMS CUSTOM HOUSE: PORT AREA VISAKHAPATNAM-530035 F No. S6/11/17-ITP Cell(Pt.-1) Dated: 15.12.2017 Public Notice No. 56/2017 Sub : Re-export of imported durable containers within the six months from the date of importation- Reg. Attention of all the Importers, Exporters, Custom Brokers, Steamer Agents, Trade, Liners, Custodians, Main Line Operators (MLO) and all others concerned is invited to Customs Notification No. 104/94-Cus. dated 16.03.1994. In terms of the same, the Imported durable containers are exempted from the whole of the duty of customs and the additional duty leviable provided that the importer execute a bond binding himself to re-export the said containers within six months from the date of their importation and to furnish documentary evidence thereof or to pay the duty leviable thereon in the event of the importer's failure to do so. Therefore, the Liners/ Shipping Agents who are registered with ITP Cell by executing Continuity Bond (CO Bond) are required to re-export the containers within six months from the date of importation or extension has to be sought from the proper officer for further period as per the Customs Notification No. 104/94 dated 16.03.1994 and Circular No. 83/98-Customs, dated 05.11.1998. 2. It is noticed that very often, the Liners/Shipping Agents are not submitting the proof of re-export i.e. Transshipment Applications (TSAs) to ITP Cell to get their respective CO Bonds re-crediting the debited amount against the imported durable containers even after expiry of six months. 3. As a result of this, some container Bonds stands pending for closure. Therefore, the Liners/Shipping Agents are directed to submit the proof of re- export of imported durable containers within a week time positively after sailing of the vessel or timely extension may be obtained one month prior to validity period of the imported durable containers.
