Letters/34/2015-16/1218 Dated : 01-03-2016 TRADE NOTICE NO. 03/2016/C.E Sub: Registration of EOUs approved under Software Technology Park Scheme Under Rule 9 of the Central Excise Rules, 2002 submission of ER-2 return by these units - reg. Attention of the Export Oriented Units (including EHTP/STP/BTP set under Software Technology Park Scheme, Electronic Hardware Technology Park Scheme and Bio-Technology Park Scheme) is invited to Notification No. 31/2002-CE(NT) dated 17.09.2002, where by Notification No. 36/2001-CE(NT) dated 26.06.2001 has been amended to provide that EOUs procuring the excisable goods from Domestic Tariff Area (DTA) or removing the excisable goods to DTA shall not be treated registered unit under Central Excise on deemed basis. Therefore, EOUs including EHTP/STP/BTP procuring the excisable goods from DTA or removing the excisable goods to DTA shall be required to obtain Central Excise Registration addition to obtaining Private Bonded license under the Customs Act, 1962. 2. Further a monthly return in terms of sub rule 3 of Rule 17 of the Central Excise Rules, 2002 is also required to be filed by EOUs /EHTP/STP/BTP units within 10 days of the close of the month to return relates. The is in of excisable goods manufactured in the EOUs/STP/EHTP/BTP unit and inputs and capital goods received in the unit. The form ER-2 as notified by Notification No. 26/2004-CE(NT) dated 27.09.2004 and Notification No. 24/2008-CE(NT) dated 23.05.2008 is applicable for EOU/STP/EHTP/BTP and in addition to the goods Manufactured tie details of duty free inputs or capital goods, procured from indigenous sources or imports is required to be indicated in the return Besides the quantity cleared as such or inter unit transfer made or received is required to be reflected in the monthly ER-2 Return. 3. It has come to notice most of the STP units are not complying With aforesaid requirement and in this background the trade notice is being issued to ensure the compliance of these explicit provisions by EOU/STP/EHPT/BTP units. 4.
