Constitution of Regional Advisory Committee in GST regime - GST - Trade Notice No. 06/DL/2017

No. CCU(DZ(CX/Tech-I/21/2015-16 Dated: 11.10.2017 Trade Notice No. 06/DL/2017 Sub:- Constitution of Regional Advisory Committee in GST regime-reg. Trade and industry may be aware that the Regional Advisory Committee (RAC) for Central Excise Service Tax was functioning in this zone, which had the jurisdiction over Haryana State and NCT of Delhi. The meeting of RAC was held once in three months and was chaired by the Chief Commissioner of Central Excise Service Tax, Delhi. 2. Now, after implementation of GST from 1 st July, 2017, a lot of changes have come in Delhi Zone. The State of Haryana is now a part of Panchkula Zone and is no more under the jurisdiction of Delhi Zone. Service Tax Delhi Zone has been merged with the Central Tax CX, Delhi Zone. 3. In view of above and in compliance to the Board's Circular No. 953/14/2011 dated 12.09.2011, it has been decided to constitute a fresh RAC under the jurisdiction of Delhi Zone. The important facts about RAC are following : (a) A single RAC is being constituted for all the assesses of Central Tax CX, Delhi Zone. (b) The number of members in the RAC will be 16 so that all the registered Trade Associations, Chambers within the zone are adequately represented. Representatives of the State Government, Manufacturers, Exporters' Association, PSU etc. may also be included in the RAC. (c) The Chief Commissioner will have the power to co-opt three members from the industry or assessee group important from the zonal point of view f r a specific period or f r a particular meeting. \ (d) The RAC meetings are to be convened on a quarterly basis under the Chairmanship of the Zonal Chief Commissioner. 4. In compliance of the Board's decision as above, nominations are being called from the trade and industry for membership of the RAC to be constituted for all assesses of Central Tax CX, Delhi Zone. The same may be submitted to this office through jurisdictional Commissionerates latest by 31.10.2017. 5. Functions: The functions of the Regional Advisory Committee will be purely advisory and it is intended for resolving procedural difficulties of a general nature. It may, however, discuss any matter, including the policy behind individual cases but excluding the individual cases and judicial semi-judicial matters. 6. Life period of the Committee: The committee is being constituted for a period of two calendar years and accordingly, the term of office for each member nominated to the committee will be two years. 7. Meetings of the Committee: The committee shall normally meet once in a quarter on such date as the Chairman may decide. Members of the RAC shall be informed in advance about the date and time as well as the venue of holding the meetings. This issues with the approval of the Chief Commissioner.
