Special drive for disbursal of pending cases of Brand Rate Fixation at ICD, Air Cargo Complex (Export) Delhi - Customs - Public Notice No. 27/2017-18

OFFICE OF THE COMMISSIONER OF CUSTOMS AIR CARGO EXPORT, NEW CUSTOMS HOUSE, NEW DELHI C.NO.VIII(12)/ACE/BRFC/PN/248/2017-18/16129 Dated : 12.03.2018 Public Notice No. 27/2017-18 Subject: - Special drive for disbursal of pending cases of Brand Rate Fixation at ICD, Air Cargo Complex (Export) Delhi-reg. Attention of the exporters and all concerned is invited to the notification no. 58/2017-Cus(N.T.) dated 29.06.2017 wherein the work related to fixation of Brand Rate of drawback under Rules 6 7 of the Drawback Rules, 1995 has been assigned to Customs Commissionerates having jurisdiction over the place from where export of goods takes place. These rules were replaced by the Drawback Rules, 2017 vide Notification no. 88/2017-Cus(N.T.) dated 21.09.2017, Circular No. 23/2017-Customs dated 30.06.2017 and Circular No. 38/2017-Customs dated 22.09.2017 issued by CBEC available on CBEC website with regard to finalization of applications for fixation of Brand Rate. Further, in terms of Rule 20 of the Drawback Rules, 2017, Brand Rate of Drawback already fixed would not apply for exports with Let Export Order dated 01.10.2017 onwards and the exporters were required to apply fresh for fixation of Brand Rate under Rules 6 7 for such exports. It was also stated that if required, verification of the data given in the application would be got done through the Customs formation having jurisdiction over the factory where the export goods have been manufactured. A special drive is initiated up to 30.04.2018 to dispose of ail application for fixation of Brand Rate pending beyond one month so that nil pendency is achieved by 30.04.2018. In this regard all the exporters/CHAs are requested to contact this office within 10 days to submit a request along with relevant documents as required to process the cases of disbursal of drawback under Brand Rate fixation for their early disposal. In case the brand rate has not been fixed as yet the name and details of jurisdictional Central Excise Commissionerate/GST Commissionerate and concerned Range where the brand rate application was filed, may also be intimated so that office may contact concerned Commissionerate to get the records transferred to this Commissionerate. Exporters/CHAs are hereby informed that a Brand Rate Fixation Cell (BRFC) under AC (BRFC) has been formed in this Commissionerate coinprising of AC (BRFC) Superintendent (BRFC) and Inspector (BRFC) at Air Cargo Export Commissionerate, New Customs House, near IGI Air Port, New Delhi.
