F. No. S/6-Misc-02/07 Exp FSP Date: 14.03.2011 PUBLIC NOTICE No. 30/2011 Sub: Grant of LoFSP to Manufacturer Exporter for goods under Export Promotion Schemes alongwith Free Goods reg. Attention of the Exporters, CHA Trade seeking One Time/ One Day Factory Stuffing Permissions is invited to the Boards Circular No. 860/18/2007-CX dated 22.11.2007 wherein at para 3 of the Circular it is mentioned that in the case of exports under Free Shipping Bill i.e. Shipping Bills wherein no export benefits are being sought, the manufacturer-exporter shall mandatorily resort to self-sealing of containers. The Central Excise Officers shall not attend to the request of stuffing and sealing of export containers in their presence, for the exports which are under Free Shipping Bills. Hence, in terms of the Boards Circular, a Public Notice No.27/2010 dated 08.03.2010 was issued in by this Custom House, whereby the Factory Stuffing Permission granted in the past to manufacturer exporters for export of goods under free shipping bills were cancelled. 2. Representations have been received from various Small Manufacturer Exporters and Exporters Associations stating that they are facing problems as the Central Excise officers refuse to supervise the stuffing of containers wherein some goods are exported under DBK/DEPB etc. and some are under Free Shipping Bills though being stuffed together. They have therefore requested to allow stuffing of containers in their factory premises under Central Excise supervision for the Manufacturer Exporter who intends to export goods under Export Promotion Schemes alongwith Free Goods (i.e. goods without any export incentive) stuffed in the same container. 3. The matter has been examined and it has been decided in consultation with the Central Excise Authorities, that, in case a Manufacturer Exporter intends to export a variety of goods falling under both Export Promotion Schemes and Free Goods (i.e. goods without any export incentive) together in the same container under the supervision of the jurisdictional Central Excise Authorities, LoFSP shall be issued to such Manufacturer Exporter subject to fulfillment of the other conditions prescribed in the Public Notices and Instructions issued from time to time. 4. The Exporters, Trade concerned Asstt./Dy. Commissioners of Customs/ Central Excise are requested to take note. 5. Public Notice No.27/2010 dated 08.03.2010 stands amended to the above extent. 6.
