Minutes of the 107th meeting of the Board of Approval for SEZ held on 25th November, 2021 to consider setting up of Special Economic Zones and other miscellaneous proposals - SEZ - Minutes of the 107th meeting of the SEZExtract Minutes of the 107th meeting of the Board of Approval for SEZs held on 25th November, 2021 The One Hundred and Seventh (107th) meeting of the Board of Approval (BoA) for Special Economic Zones (SEZs) was held on 25th November, 2021 under the chairmanship of Shri B.V.R Subrahmanyam, Secretary, Department of Commerce, at 4.00 P.M. in Room No. 141, Udyog Bhawan, New Delhi. The list of participants is annexed ( Annexure-I ). 107.1 Ratification of the minutes of the 106th meeting of the Board of Approval held on 07.10.2021. The Board, ratified the minutes of the 106th meeting of the BoA held on 7th October, 2021. 107.2 Request for extension of LoA of the units (five proposals) 107.2(i) Request of M/s Soft Rainbow Color Private Limited in the Plot No Z/71 Z/72 Dahej SEZ Ltd, Dahej, Village: Luvara, Tal: Vagra, Dist: Bharuch, Gujarat for the extension of the Letter of Approval (LOA) upto 31.10.2022. The Board, after deliberations, approved extension of the validity of LoA up to 31st October, 2022. 107.2(ii) Request of M/s. Algolog Systems Pvt. Ltd. in Ansal IT City Parks Ltd., IT/ITES SEZ at Plot No. TZ-06, Tech zone, Greater Noida (U.P.) for extension of Letter of Approval (LOA) for a further period of one year i.e., upto 25.10.2022. The Board, after deliberations, approved extension of the validity of LoA up to 31 st March, 2022. 107.2(iii) Request of M/s Wockhardt Limited Unit 3 at Shendre, Aurangabad, Maharashtra for extension of the validity period of LoA for a period of one year upto 24.10.2022. The Board, after deliberations, approved extension of the validity of LoA up to 24th October, 2022. 107.2(iv) Request of M/s Vidya Herbs Private Limited in the KIADB (Pharmaceutical) SEZ, Hassan, Karnataka for extension of Letter of Approval (LoA) beyond 26.10.2021 for a period of one year up to 26.10.2022. The Board, after deliberations, approved extension of the validity of LoA up to 26th October, 2022. 107.2(v) Request of M/s Wipro Enterprises Private Limited (Unit-II) in the KIADB(Aerospace) SEZ, Bangalore, Karnataka for extension of Letter of Approval (LOA) for a period of one year beyond 19.11.2021. The Board, after deliberations, approved extension of the validity of LoA up to 19th November, 2022. 107.3 Requests for co-developer (three proposals) 107.3(i) Request of M/s. Pluto Fin Tech Private Limited for co-developer status in Cessna Business Park SEZ for property management and other infrastructure services. The Board, after deliberations, approved the proposal of M/s. Pluto Fin Tech Private Limited for co-developer status for property management and other infrastructure services (viz. Engineering Maintenance including electrical and mechanical work etc. as per schedule 2 of the agreement) in the entire area of the SEZ (17.99 hectares) in accordance with the codeveloper agreement dated 9th September, 2021 entered into with the developer subject to standard terms and conditions as per the SEZ Act and Rules provided that the lease period shall be in accordance with DoC's Instruction No. 98 dated 29.08.2019. 107.3(ii) Proposal of M/s. Xenosoft Technologies (India) Private Limited for approval of Co-Developer Status in M/s. APIIC limited, IT/ITES SEZ, Hill No. 3, Madhurwada, Visakahaptnam. The Board, after deliberations, approved the proposal of M/s. Xenosoft Technologies (India) Private Limited for co-developer status for undertaking infrastructural facilities viz. leasing of space to units, all operational and maintenance facilities in office building with a built-up area of 3,10,000 sft. with 4 cellars and 4 floors for the authorized operations in M/s. APIIC Limited in accordance with the co-developer agreement dated 21st October, 2021 entered into with the developer subject to standard terms and conditions as per the SEZ Act and Rules provided that the lease period shall be in accordance with DoC's Instruction No. 98 dated 29.08.2019. 107.3(iii) Request of M/s State Industries Promotion Corporation of Tamil Nadu Limited for co-developer status in the IT/ITES Electronic components and Hardware manufacturing and related services SEZ developed by M/s. Flextronics Technologies India Pvt. Ltd. at SIPCOT Industrial Park, Phase II, Sandavellur C Village, Sriperumbudur Taluk, Kancheepuram District. The Board noted that request of the co-developer to undertake basic infrastructure facilities viz. roads, storm water drains facility, street lights, water supply distribution lines, avenue plants etc. for facilitating the industrial units in the 60.73 Ha area out of the total notified area of 76.14 Ha was approved in the 104th meeting of the BOA held on 28th May, 2021 subject to execution of necessary co-developer agreement with the developer and compliance of relevant provisions of the SEZ Act and Rules. Subsequently, the co-developer was granted an LoA on 7th June, 2021. Now, the co-developer has entered into an agreement with the developer on 16th September, 2021 to the above effect. The same has been taken on record by the Board. 107.4 Miscellaneous cases (two proposals) 107.4(i) Request of M/s. T V Holdings Pvt, Ltd. for cancellation of LoA issued to them as Co-Developer of M/s. Estancia IT Park Pvt. Ltd., Chennai. The Board, after deliberations, approved cancellation of co-developer status granted to M/s. T V Holdings Pvt. Ltd. in the aforesaid SEZ subject to fulfilment of all statutory requirements. 107.4(ii) Request of M/s. Mariapps Marine Solutions (I) Pvt Ltd., Co-Developer for acquiring additional land of 0.04047Ha (10 cents), on lease basis, from the Developer, M/s Smartcity (Kochi) Infrastructure Pvt Ltd. The Board, after deliberations, approved the proposal of M/s. Mariapps Marine Solutions (I) Pvt. Ltd. for acquiring additional land area admeasuring 0.04047 Ha (10 cents) on lease basis for creation of additional infrastructure subject to Lease-cum-Development Agreement being entered into with the developer for the additional area and also subject to standard terms and conditions as per the SEZ Act and Rules provided that the lease period shall be in accordance with DoC's Instruction No. 98 dated 29.08.2019. 107.5 Industrial License (Two proposals) 107.5(i) Proposal of M/s RJT Tobaccos Pvt. Ltd. for setting up of SEZ unit at Visakhapatnam SEZ, Duvvada, Andhra Pradesh for manufacture of Cigarettes, Cigars, Cheroots and other tobacco products under IDR Act, 1951. The Board, after deliberations decided to approve the proposal with the following conditions: i. The manufacturing unit shall have the latest advanced technology. ii. Special efforts should be made to have minimal pollution effect. iii. The unit shall use at least 80% indigenous tobacco. iv. There shall be 100% exports and no DTA sale will be allowed. 107.5(ii) Proposal of M/s Rockman Advanced Composite Pvt. Ltd. (an SEZ unit under jurisdiction of Surat SEZ) for manufacturing allied items of defence equipment under IDR Act, 1951. The Board, after deliberations, approved the proposal subject to the condition that the stipulations with respect to monitoring, security audit, other compliance verification mechanisms and consequential requirements as per the Security Manual issued by the Department of Defence Production shall be undertaken by Ministry of Defence and Ministry of Home Affairs as specified in the said Manual who shall be informed of the same. Decision on Supplementary Agenda 107.6 Request for extension of validity of formal approval of developer (one proposal) 107.6(i) Request of M/s. Nagaland Industrial Development Corporation Ltd. SEZ for further extension of the validity period of the Formal Approval granted for setting up a sector specific SEZ for Agro and Food Processing beyond 02.12.2020. The Board, after deliberations, approved extension of the validity of formal approval up to 2nd December, 2022. 107.7 Request for extension of LoA of the units (two proposals) 107.7(i) Request of M/s Atar Mohd Saeed Dawood Private Limited, unit in JNPT SEZ, Navi Mumbai for extension of the validity period of LoA for a period of one year from 20.08.2021 to 20.08.2022. The Board, after deliberations, approved extension of the validity of LoA up to 20th August, 2022. 107.7(ii) Request of M/s Reliance Infrastructure Ltd. a unit located at Plot no. 4-11, Dhirubhai Ambani Defence Park, Reliance Aerostructure Ltd., Mihan SEZ for extension of the validity of Letter of Approval (LoA) for a period of one year beyond 26.09.2021. The Board, after deliberations, approved extension of the validity of LoA up to 26th September, 2022. 107.8 Request for co-developer (one proposal) 107.8(i) Request of M/s Higher Heights Technology for co-developer status in Mihan SEZ at Nagpur developed by Maharashtra Airport Development Co. Ltd. for providing infrastructure facilities and its maintenance. The Board, after deliberations, approved the proposal of M/s. Higher Heights Technology for co-developer status for providing infrastructure facilities such as constructed, bare warm shell, warm shell with Plug Play facilities, Internet facilities Wifi, Common Server Rooms, Common Cafeteria, Common Garden, Power Back-up facilities and maintenance thereof at Plot No. 21 (4046.861 sq. mtrs), Sector-1 8, MIHAN SEZ, Nagpur in accordance with the co-developer agreement dated 25th August, 2020 entered into with the developer subject to standard terms and conditions as per the SEZ Act and Rules provided that the lease period shall be in accordance with DoC's Instruction No. 98 dated 29.08.2019. 107.9 Proposal for increase in area of developer (one proposal) 107.9(i) Request of M/s. J. Matadee Free Trade Zone Private Limited, an FTWZ located at Mannur and Valarpuram Villages, Permbakkam Road, Sriperumbudur Taluk, Kancheepuram District, Tamil Nadu, for an increase in area of 9.333 Ha (beyond 10%) to their existing notified area of 84.775 Ha. The Board, after deliberations, approved the request of M/S. J. Matadee Free Trade Zone Private Limited for increase in area of 9.333 hectares, subject to the condition that the developer shall ensure access to the three plots with Survey nos.455/3B, 453/1A and 453/1B which are not part of the SEZ. Further, DC, MEPZ shall inspect the site to ensure that the said condition is complied with and provide compliance report to DOC along with revised map duly signed by local revenue authorities and countersigned by DC. 107.10 Miscellaneous proposal (one proposal) 107.10 (i) Request of M/s Ambika Scrap Recycling Pvt. Ltd. for renewal of LoA in respect of their metal scrap recycling unit and plastic recycling unit in KASEZ. The Board, after deliberations, decided to treat the proposal as withdrawn and directed DC, KASEZ to re-examine the case and submit a consolidated proposal so that the same may be taken up with the Department of Revenue along with the all necessary documents as specified by DoR in their observations. ******** ANNEXURE - I List of Participants for the Meeting of the Board of Approval for Special Economic Zones held on 25th November, 2021 under the Chairmanship of Commerce Secretary, Department of Commerce. 1.
