No. S/5-Gen-77/2015-16 CFS M CELL Date: 09.11.2023 Public Notice No. 101 /2023 M/s TG Terminals Private Limited, located at Village: Veshvi, Post: Dighode, Tal: Uran, District: Raigad, Maharashtra - 410 206, was appointed as Custodian under Section 45 of the Customs Act, 1962 and also approved as Customs Cargo Service Provider under rule 10 of the Handling of Cargo in Customs Areas Regulations, 2009 vide CFS Notification No.05/2016 dated 01.09.2016 for an area admeasuring 60,650 SQM. Later on, their appointment as Custodian and approval as Customs Cargo Service Provider were renewed vide CFS Notification Nos. 02/2019 and 03/2019 both dated 22.05.2019 respectively having validity for 10 years from the date of its issuance. 2. The National Company Law Tribunal, Mumbai Bench-I has, vide order dated 4th October, 2023, in the matter of CP (CAA)/161 /MB-I/2023 IN CA (CAA) /17/MB/2022, sanctioned the Scheme of Amalgamation and Arrangement of TG Terminals Private Limited (Transferor Company) with Transworld Terminals Private Limited (Transferee Company) under Sections 230-232 of the Companies Act, 2013 and other applicable provisions of the Companies Act, 2013 read with the Companies (Companies, Arrangements and Amalgamations) Rules, 2016. Hence, all the business activities like operation of Container Freight Station (CFS) and all other related ancillary allied activities shall be carried out by M/s Transworld Terminals Private Limited. Accordingly, M/s Transworld Terminals Private Limited applied for transfer of the Custodian license of TG Terminals Private Limited in favour of Transworld Terminals Private Limited. 3, Now, in exercise of the powers conferred by sections 45(1) and 141(2) of the Customs Act, 1962, 1, D. 5. Garbyal, the Commissioner of Customs, NS- General, JNCH hereby approve the name change of M/s TG Terminals Private Limited to M/s Transworld Terminals Private Limited and appoint M/s Transworld Terminals Private Limited to be the Custodian of the imported goods received at . the Container Freight Station of M/s Transworld Terminals Private Limited until ; these are cleared for home consumption or are warehoused or are transhipped in accordance with the provision of Chapter VIII of the Customs Act, 1962 for entire Customs Area of 60,650 SQM. Similarly, M/s Transworld Terminals Private Limited will also be the Custodian of the export goods brought into the said Container Freight Station for examination and stuffing till their exportation through Jawaharlal Nehru Port. 4. Further, in exercise of the powers conferred by regulation 10 of the Handling of Cargo in Customs Areas Regulations, 2009, I, D. S. Garbyal, the Commissioner of Customs, NS- General, JNCH approve M/s Transworld Terminals Private Limited as a Custom Cargo Service Provider for the above mentioned Container Freight Station subject to the following conditions- (i) The Custodian M/s Transworld Terminals Private Limited, approved as Customs Cargo Services Provider for the said CFS, shall abide by all the provisions of the Customs Act, 1962 and the rules under the Handling of Cargo in Customs Areas Regulations, 2009 and other regulations, notifications, orders issued there under. (ii) The duration of appointment of M/s Transworld Terminals Private Limited as Custodian and as the Customs Cargo Service Provider shall remain valid up to 21.05.2029 from the date of issue of this Public Notice provided the validity of the AEO-LO status of the CFS extended. If the validity of AEO Certificate No.INAAACM3711HOF211 dated 31.03.2021 granted to the CFS is withdrawn prior to the 30.03.2026 or is not extended beyond 30.03.2026, the validity as Custodian and as the Customs Cargo Service Provider shall be valid for a period of five (05) year from the date of issue of this Public Notice. (iii) The waiver from execution of Bank Guarantee has been given in terms of regulation 5(3) of HCCAR, 2009 as the CFS has been accredited with AEO- LO status with validity till 30.03.2026. If, the validity of AEO status o granted to the CFS is withdrawn prior to the 30.03.2026 or is not extended beyond 30.03.2026, the CFS shall execute bank guarantee for the amount, as determined, w.e.f. the date of expiry of validity of AEO status. (iv) M/s Transworld Terminals Private Limited will submit the copy of MPCB consent after transfer of name in the name of M/s Transworld Terminals Private Limited. At present, the MPCB consent is in the name of M /s TG Terminals Private Limited and the MPCB Consent is yet to be amended in the name of M/s Transworld Terminals Private Limited by MPCB. (v) The Commissioner of Customs, NS-General, JNCH shall have the Right to review the approval as Customs Cargo Services Provider before 21.05.2029 for failure to comply with any of the Regulations of the Handling of Cargo in Customs Areas Regulations, 2009 or as per the directions of the Government of India.
