Reference the provision for the certification of licenced capacity of cement units as required under notification No. 36/87-Central Excises, dated 1-3-1987 and notification No. 124/87-Central Excises, dated 29-4-1987. For the period prior to 1-3-1987 such certificates were to be obtained only from the Development Commissioner for Cement Industry in the Ministry of Industries. Consequently those units which were not registered with the Development Commissioner for Cement industry could not obtain such certificates for the period prior to 1-3-1988 with the result that they could not avail the benefit of these notifications. However, with effect from 1-3-1988 the Director of Industries in the State Government and the DGTD were also authorised to issue such certificates as required under these notifications. 2. The matter has been examined in consultation with the Department Commissioner for Cement Industry in the Ministry of Industries. It is hereby clarified that such units which obtained the necessary licenced capacity certificates from the Director of Industries in the State Government or the DGTD, during the period prior to 1-3-88 may be ask to get such certificates counter-signed by the Development Commissioner for Cement Industry in the Ministry of Industries, provided these certificates are otherwise in order and fulfil the requirements of the notifications 36/87-CE and 124/87-C.E. as they were inforce prior to 1-3-1988. The pending demands/refund cases may be disposed of accordingly.
