No. 208/14/88-CX.6] Government of India Ministry of Finance (Department of Revenue) New Delhi Subject : Publication of names of offenders under the Central Excise Law - Instructions regarding. Attention is invited to rule 232A of the Central Excise Rules, 1944 which provides for publications of names and other particulars of persons who have been convicted/punished by the Court or who have been found by the adjudicating officer to have contravened any of the provisions of the Act or rules made thereunder. Attention is also invited to Board's letter F. No. 207/8/75-CX.6, dated 23-3-1976 (copy enclosed) wherein it was impressed upon the Collectors that provision of rule 232A should be invoked liberally so as to create a proper climate against evasion of Central Excise duties. It however appears that these instructions are not being uniformly followed by all the Collectors. The Board has therefore directed that instruction, dated 23-3-1976 may be complied in letter and spirit. In future a copy of letter addressed to Controller of Publication for publishing the particulars of conviction awarded may be sent to Board.
