In continuation of Board's Circular No. 14/81-CX.6, dated 12-2-1981 F. No. 215/3/80-CX.6, I am directed to invite your attention to Rule 57F(1)(ii) of the Central Excise Rules, 1944 wherein it has been provided that the inputs received in a factory may be sent for carrying out operations to a place outside the factory subject to the permission of Collector. The power of the Collector under this rule has been delegated to the Assistant Collector. 2. It has been represented by the Trade that considerable time is taken to receive the permission of the Asstt. Collector and it has therefore, been suggested that these powers of the Collector should be delegated to the Range Superintendent. Under similar circumstances provision already exists under Rule 56A(3)(iii) where the Range Superintendent can allow such removal. Keeping in view the practical difficulties of the trade it has been decided to delegate the powers of Collector under Rule 57F(1)(ii) to the Range Superintendent, Collectors may issue suitable notification in this regard. 3. It may be ensured that requests of the trade for permission under the aforesaid rule may be promptly attended to and there should be no case for any delay in disposal of such cases. 4. The trade may be suitably informed. 5. Please acknowledge receipt of this matter.
