Central Excise Provision for deemed credit in respect of iron steel copper, aluminium, zinc and lead Order F. No. B.22/5/86-TRU, dated 7-4-1986 Modification regarding F. No. B.22/5/86-TRU, dated 7-4-1986 Modification regarding. In the deemed credit order F. No. B.22/6/86-TRU, dated 7-4-1986 the items mentioned, include, among others waste and scrap of iron and steel falling under Heading No. 72.03 and ship breaking scrap falling under heading No. 72.15. Waste and scrap of Iron Steel falling under heading No. 72.03 have been exempted from excise duty and additional duty of customs under notification No. 208/83-C.E., dated 1-8-1983, notification No. 55/86-C.E., dated 10-2-1986 and under other notifications. Similarly goods and materials falling under Heading No. 72.15 has been exempted from excise duty vide Notification No. 386/86-C.E., dated 20-8-1986. It has been brought to the notice of the Government that in respect of waste and scrap of steel to nil rate duty, credit under Modvat has been claimed by some manufacturers though it has been clearly provided for in the said order that no such credit shall be available in such cases.
