INSTRUCTION NO 175/CBDT, Dated: May 22, 1970 Section(s) Referred: 230A Statute: Income - Tax Act, 1961 Section 230A prohibits registration of a document purporting to transfer, assign, limit or extinguish the title or interest of any person to or in any property(other than Agricultural land) valued at more than Rs.50,000 unless an ITO certifies that such person has either paid, or made satisfactory arrangements for payment of all existing liabilities under the various Direct Taxes Act, or that the registration of the document will not prejudicially affect the recovery of any such liability. 2. Instances have been brought to the notice of the Board, where the issue of certificates u/s.230 A has been delayed resulting in considerable hardhsip and inconvenience to the persons proposing to effect transfer of their properties. The Board desire that in all cases where applications for tax clearance certificates have been received, suitable action should be taken within a week of the receipt thereof. 3. These instructions may please be brought to the notice of all the officers in your charge.
