Writing off of tax arrears. - Income Tax - 1380/CBDTExtract INSTRUCTION NO. 1380/CBDT Dated: February 3, 1981 In inviting reference to Board's Instruction No 1355 dated 16th September 1980 wherein instructions regarding writing off of tax arrears in certain cases of income arising in Bangladesh were issued. 2. The Board has further considered the question of writing off tax arrears attributable to incomes earned in Bangladesh in cases where the claims have been filed by such assessees with the custodian of Enemy property in India and ex-gratia payments have been sanctioned to them in respect of the assets movable or immovable left in that country. It has been decided that in cases, where ex-gratia payments have been made by the Govt. to the assessees or where claims have been filed with the custodian of Enemy property in India, should not be processed for write off except where the value of the total claims and other assets if any is less than 25% of the tax arrears and partial write off can be considered within the existing instructions. 3. Efforts should be made to reduce the outstanding demands by granting DIT relief on the basis of the certified copies of the documents as in the case of countries other than Bangladesh. 4. This may please be brought to the notice of all officers in your charge.
