Notification No. 7/2/98/ADD Dated 12-11-1998 Subject : Initiation of new shipper review of anti-dumping duty imposed on PTA originating in or exported by PT Amoco Mitsui PTA Indonesia M/s. PT Amoco Mitsui PTA Indonesia ha filed a petition before the Designated Authority under the Customs Tariff (Amendment) Act, 1995 and Customs Tariff (Identification, Assessment and Collection of Anti Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 , requesting review of the anti-dumping duty recommended by the Designated Authority (referred to as Authority hereinafter) vide notification No. 58, dated 19th March, 1998 on all exports of PTA by the company. 1. Exporter involved : The present investigations relate to exports of Purified Terephthalic Acid (referred to as PTA in this notification) by PT Amoco Mitsui PTA Indonesia, Indonesia. 2. Initiation of Anti-dumping Investigation : The Customs Tariff (Amendment) Act, 1995 and the Rules made thereunder require the Authority to periodically review for the purpose of determining individual margin of dumping for any exporter or producer in the exporting country in question who has not exported PTA to India during the investigation period. The petitioner has furnished sufficient prima facie evidence that it satisfies the conditions prescribed under Rule 22 of the rules supra and has requested for separate dumping margin. 3. The Authority having been satisfied that there is a need for review of anti-dumping duty on exports of PTA by PT Amoco Mitsui PTA Indonesia considers that the anti-dumping duty imposed by the Central Govt. in pursuant to the recommendations made by the Authority vide notification No. 58, dated 19th March, 1998 needs to be reviewed with regard to PT Amoco Mitsui PTA Indonesia. 4. Having decided to review the final findings notified vide notification No. 58, dated 19th March, 1998 with regard to PT Amoco Mitsui PTA Indonesia, the Authority hereby initiates investigations to determine separate dumping margin in respect of PT Amoco Mitsui PTA Indonesia in accordance with the Rules supra. 5. The Authority recommends provisional assessment of all exports made by PT Amoco Mitsui PTA Indonesia till this review is completed @ ₹ 1939/- pmt. 6. Period of Investigation : The period of investigation for the purpose of the present review is 1st July, 1997 to 30th June, 1998. 7. Submission of Information : The exporters and importers known to be concerned and domestic industry are being informed separately to enable them to file all information relevant in the form and manner prescribed.
