Customs House Agents Licensing (Amendment) Regulations. 1991 - 74/91 - Customs - Non TariffExtract Customs House Agents Licensing (Amendment) Regulations. 1991 Notification No. 74/91-Cus. (N.T.) Dated 15-11-1991 In exercise of the powers conferred by sub-section (2) of Section 146 of the Customs Act, 1962 (52 of 1962), the Central Board of Excise and Customs hereby makes the following regulations further to amend the Customs House Agents Licensing Regulations, 1984 (hereinafter referred to as the said regulations), namely :- 1. (1) These regulations may be called the Customs House Agents Licensing (Amendment) Regulations, 1991. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In Regulation 6 of the said regulations, for clause (a), the following clause shall be substituted, namely :- "(a) is an employee of a licensee and that he possesses a permanent pass in Form G prescribed under Regulation 20 and has the experience of work relating to clearance of goods through the customs, for a period of not less than one year, in the capacity of such a pass-holder; and" 3. In Regulation 8 of the said regulations, after Regulation 8(1), the following sub-regulation shall be inserted, namely :- "(2) Any person, whose application for grant of temporary licence under sub-regulation (1) of Regulation 8 is rejected by the Collector of Customs may represent to the Central Board of Excise and Customs against such order rejecting the grant of a temporary licence, within 30 days of the communication of the impugned order." 4. In Regulation 10 of the said regulations, after sub-regulation 10(3), the following sub-regulation shall be inserted, namely :- "(4) Any person aggrieved by the order of the Collector passed under sub-regulation (3) of Regulation 10 may represent to the Central Board of Excise and Customs against such order within 30 days of the communication of the impugned order." 5. In Regulation 23 of the said regulations, after sub-regulation 23(7), the following sub-regulation shall be inserted, namely :- "(8) Any Customs house agent aggrieved by any decision or order passed under Regulation 21 or sub-regulation (7) of Regulation 23, may appeal under Section 129A of the Customs Act, 1962, to the Customs and Central Excise Gold (Control) Appellate Tribunal established under Section 129 (1) of Customs Act, 1962."
