Effective rates of additional duty for specified projects falling under Heading No. 98.01 Notification No. 91/94-Cus. Dated 1-3-1994 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts goods specified in column (2) of the Table hereto annexed and falling under heading No. 98.01 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), when imported into India from so much of that portion of the additional duty leviable thereon under section 3 of the second mentioned Act, as is in excess of the amount calculated at the rate specified in the corresponding entry in column (3) of the said Table. Explanation. - For the purposes of this notification, the term 'Power projects (including gas turbine power projects)' shall not include Captive Power Plants set up by projects engaged in activities other than in power generation.
