Exemption to Adventure Sport Equipments Imported by Specified Importers - 105/91 - Customs -TariffExtract Exemption to Adventure Sport Equipments Imported by Specified Importers Notification No. 105/91-Cus; Dated 25-7-1991 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts Adventure Sport Equipments (hereinafter referred to as the said goods) when imported into India by specified importers, from - (a) so much of that portion of the duty of customs leviable thereon, which is specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) as is in excess of the amount calculated at the rate of 25% ad valorem; and (b) the whole of the additional duty leviable thereon under section 3 of the said Customs Tariff Act: Provided that the CIF value of the said goods imported under this notification by a specified importer do not exceed rupees one crore: Provided further that the specified importer at the time of import produces before the Assistant Collector of Customs - (1) a certificate from an officer not below the rank of Additional Industrial Adviser in the Directorate General of Technical Development of the Government of India to the effect that the said goods are not manufactured in India; (2) a certificate from the Director General of Tourism in the Ministry of Tourism of the Government of India (hereinafter referred to as the said Director General), to the effect that the said goods are required for adventure sports; and (3) a recommendation from the said Director General for the grant of exemption under this notification, Explanation. - For the purposes of this notification, "specified importer" means the Ministry of Tourism, State Tourism Department or State Tourism Corporation, or Hotel, Tour Operator or Travel Agent approved by Director General of Tourism in the Ministry of Tourism, Government of India.
