Exemption to machinery, equipment, instruments etc. imported by work centres of the ATV programme, Government Agencies and Public Sector Undertakings - 177/90 - Customs -TariffExtract Exemption to machinery, equipment, instruments etc. imported by work centres of the ATV programme, Government Agencies and Public Sector Undertakings Notification No. 177/90-Cus. Dated 31-5-1990 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts machinery, equipment, instruments, fittings, devices, scientific apparatus, components, spares, tools, accessories, computer hardware, computer software, castings, forgings, pipings, tubings, raw-materials and consumables (hereinafter referred to as the said goods) required for the purposes of the Advance Technology Vessels Programme of the Ministry of Defence (hereinafter referred to as the ATV Programme), when imported into India by Work Centres of the ATV Programme, Government agencies and public sector undertakings, as may be designated by an officer not below the rank of a Deputy Secretary to the Government of India in the Ministry of Defence, from - (i) the whole of the duty of customs leviable thereon which is specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975); and (ii) the whole of the additional duty leviable thereon under section 3 of the said Customs Tariff Act: Provided that Work Centres of the ATV Programme, Government Agencies or public sector undertakings, designated in this behalf by the Ministry of Defence, produce to the Assistant Collector of Customs, at the time of importation, in each case, a list of the said goods with relevant description of such goods duly certified by - (i) the Programme Director, Advance Technology Programme, Department of Defence Research and Development, to the effect- (a) that the said goods mentioned in the list are required for the purposes of the ATV Programme; (b) that the said goods are not manufactured in India; (c) that the said goods shall be used only for the purposes of the ATV Programme; and (ii) an officer not below the rank of an Under Secretary to the Government of India in the Ministry of Defence to the effect that the import of the said goods mentioned in the said list are authorised by the Ministry of Defence under and for the purposes of the ATV Programme. 2. This notification shall remain in force upto and inclusive of the 31st day of December, 1995.
