Exemption to membranes for caustic soda plant - 179/89 - Customs -TariffExtract Exemption to membranes for caustic soda plant Notification No. 179/89-Cus. Dated 6-6-1989 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts membranes imported for replacement of worn out membranes in a Cuastic Soda Plant based on membrane cell technology, from so much of that portion of the duty of customs leviable thereon, which is specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) as is in excess of the amount calculated at the rate of 30 per cent ad valorem and the whole of the additional duty of customs leviable under section 3 of the said Customs Tariff Act : Subject to the condition that at the time of import, the importer produces a certificate from an officer not below the rank of Additional Industrial Advisor of the Directorate General of Technical Development of the Ministry of Industry or by an officer not below the rank of Joint Director of Industry specifically authorised by Director of Industry or the Commissioner of Industry of the State concerned in the case of firms which are classified as falling in the small scale sector, to the effect that the membranes imported are for the purpose of replacement of worn out membranes and indicating therein the quantity of membranes so required.
