Exemption to tensilised polyester film [ Ch. 39] Notification No. 231/87-Cus. Dated 5-6-1987 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts Tensilised Polyester Film of thickness not exceeding 30 microns, falling within Chapter 39 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), when imported into India for the purpose of manufacture of Magnetic tapes, from - (a) so much of that portion of the duty of customs leviable thereon which is specified in the said first schedule, as is in excess of the amount calculated at the rate of thirty per cent ad valorem; and (b) so much of that portion of the additional duty leviable thereon under section 3 of the said Customs Tariff Act, as is in excess of Rupees twenty-five per kilogram, subject to the following conditions, namely :- (i) an officer not below the rank of a Joint Director in the Department of Electronics of the Government of India or a Joint Director in the Directorate of Indus tries of the Government of a State or an Additional Industrial Adviser in the Directorate General of Technical Development of the Government of India is satisfied that the goods in question are required for the purpose specified above and recommends grant of the above exemption : Provided that this condition shall not apply in the case of goods imported against supplementary import licences; (ii) the importer furnishes an undertaking to the Assistant Collector of Customs, at the time of importation, to the effect that - (a) the said imported goods shall be used for the purpose specified above; and (b) the importer shall pay, on demand, in the event of his failure to comply with (a) above, an amount-equal to the difference between the duty leviable on such quantity of the said imported goods but for the exemption contained herein and that already paid at the time of importation. Explanation. - For the purposes of this notification, "Polyester Film" shall mean polyester film without any treatment or coating of magnetic material and shall not include the Magnetic Tapes in any form.
