Exemption to specified items required for photovoltaic applications - 085/87 - Customs -TariffExtract Exemption to specified items required for photovoltaic applications Notification No. 85/87-Cus. Dated 1-3-1987 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satis fied that it is necessary in the public interest so to do, hereby exempts the goods specified in column (3) of the Table hereto annexed and falling within Chapters of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), specified in the corresponding entry in column (2) of the said Table, when imported into India for manufacture of goods specified in the corresponding entry in column (4) of the said Table, from so much of the duty of customs which is leviable thereon under the said First Sche dule, as is in excess of the amount calculated at the rate specified in the corresponding entry in column (5) of the said Table and from the whole of the additional duty leviable thereon under section 3 of the second-mentioned Act, subject to the following conditions, namely :- (i) an officer not lower in rank than a Principal Scientific Officer in the Department of Non-Conventional Energy Sources of the Government of India is satisfied that the goods in question are required for the purpose specified in column (4) of the said Table and certifies to this effect and recommends grant of above exemp tion; and (ii) the importer shall, by execution of a bond in such form and for such sum as may be specified by the Assistant Collector of Customs, binds himself to pay on demand, in respect of such quantity of the goods specified in column (3) of the said Table as is not proved to the satisfaction of the Assistant Collector of Customs to have been used in the manufacture of the goods specified in the corres ponding entry in column (4) of the said Table, an amount equal to the difference between the duty which would have been levied on such quantity but for the exemption contained herein at the time of importation.
