Section 10e(4b) Of The Companies Act, 1956 - Constitution Of Board Of Company Law Administration - ORDER F. NO. 10/25/91-CLB - Companies LawExtract ORDER [F. NO. 10/25/91-CLB], DATED 23-8-1999, ISSUED BY THE COMPANY LAW BOARD Subject:- Section 10e(4b) Of The Companies Act, 1956 - Constitution Of Board Of Company Law Administration In exercise of the powers conferred by sub-section (4B) of section 10E of the Companies Act, 1956 (1 of 1956) read with Regulation 4 of the Company Law Board Regulations, 1991 and in supersession of order of even number dated 29-6-1999 the Company Law Board hereby constitutes the following Benches for the purpose of exercising and discharging its powers and functions in the manner specified below : ( a ) Matters falling under sections 235, 237, 247, 248, 250, 408 and 409 and matters falling under Chapter VI of Part VI of the Companies Act, 1956 and under section 2A of the Monopolies and Restrictive Trade Practices Act, 1969 and all other matters incidental thereto, shall be dealt with by Principal Bench consisting of not less than two Members, with the Chairman or Vice-Chairman and one from the following : 1. Sh. Justice A.K. Banerji, Chairman 2. Sh. S. Balasubramanian, Vice-Chairman 3. Sh. C.R. Mehta, Member 4. Sh. C.R. Das, Member 5. Sh. K.K. Balu, Member 6. Dr. A.K. Doshi, Member ( b ) Matters falling under sections 111, 111A and 269 of the Companies Act, 1956 and all other matters incidental thereto, shall be dealt with by the Regional Benches at New Delhi, Chennai, Calcutta Mumbai consisting of not less than two from amongst those specified in sub-para ( a ) above. ( c ) Other matters falling under the Companies Act, 1956 and all other matters incidental thereto including interlocutory applications connected with matters in ( a ) and ( b ) above and also matters under section 45QA of the Reserve Bank of India Act, 1934, shall be dealt with by a Single Member, sitting at the Regional Benches from amongst the Members specified in sub-para ( a ) above. 2. The Bench may, at its discretion, hold its sittings at any place in the territory of India. 3. Any Bench or any group of Members may, if deemed necessary, instead of disposing the case himself/themselves, refer the matter to the Principal Bench for joint consultation and disposal. 4. This order shall come into force with effect from 23-8-1999.
