Dear Sir,

We have a shipment to Republic of Congo. (Focus Market Code : A 047 & Focus Country Code : 459)

Kindly advice what is the processor to get benefit of Focus Market Scheme (2.5% of FOB). Anything has to done at the time of shipment or will be get through post shipment Application.

Urgently advice me accordingly.........

Please refer the below Public Notice.

You have to file the ONLINE APPLICATION with DGFT and after filing the online application, take the printout attached all the relevant documents like

·         RCMC Copy

·         IEC Copy

·         Custom attested ARE-1,

·         Custom attested  Invoice,

·         Custom attested  Packing List,

·         Original Copy of Export Promotion Shipping Bill,

·         AWB/ Bill of Lading,

·         Proof of landing of export consignment in specified market.

·         Disclaimer Certificate

You can file the Claim

1. With BRC

2. Without BRC : In this case you have to produce the Letter of Undertaking.

Then submit the file to the DGFT for online transmission. When you will receive the License, it needs to verified by the Customs. Once the RA is issued, you can utilize that Lic for Import Duty Payment

DIRECTORATE GENERAL OF FOREIGN TRADE

PUBLIC NOTICE NO.    100 (RE-2007)/2004-2009

NEW DELHI, DATED THE    10th January 2008

                  In exercise of powers conferred under Paragraph 2.4 of the Foreign Trade Policy 2004-2009, the Director General of Foreign Trade hereby makes the following amendments in Handbook of Procedures, Vol. I (RE2006 & RE2007):

A.     Para 3.21.1 for Focus Product Scheme is replaced as under:

"An application for exports made during 2006-07 and exports made during 2007-08 shall be filed separately, with RA concerned in ANF 3E along with documents prescribed therein. An application shall contain no more than 50 shipping bills. For exporter with more than 50 shipping bills in one year, multiple applications can be filed and supplementary cut (Para 9.4 of HBP v1) shall not be applicable.

Shipments from EDI Ports and Non-EDI Ports cannot be clubbed in one application. Port of registration for EDI enabled ports shall be any one EDI port of exports, as per the choice of the applicant.

In case of exports through non-EDI port, the port of registration shall be the relevant non EDI port of exports. Accordingly separate application shall be filed for each non EDI port.  

Last date for filing application shall be 6 months from the date of realization or date of export in case of advance payment. Date of export shall be determined as per Para 9.12 of HBP v1.  However for application filed as per procedure prescribed now, last date shall 30.7.2008, for exports from 1.4.2007 till 31.1.2008.

The above changes shall apply to FPS applications for exports made during 2006-07, for which the last date of filing is extended till 30.7.2008. The above shall not apply to applications already received, which can be finalised as per the procedure before this amendment."

B.     Para 3.22.2 for High-Tech Products Export Promotion Scheme is replaced as under:

 "In case the applicant wishes to avail the option given in Para 3.11.2 (a), the Procedure prescribed for claiming Focus Product Scheme benefits shall apply. For others, application for obtaining Duty Credit scrip for incremental growth in exports during current licensing year 2007-08 shall be filed in ANF 3F within a period of twelve months after expiry of current licensing year. Application filed in ANF 3F, shipments from EDI Ports and Non-EDI Ports can be clubbed in one application and the port of registration shall be any one of the ports of exports, as per the choice of the applicant. "

C.     Revised ANF 3E for Focus Product Scheme is annexed as Annexure 1 to this Public Notice.

D.    Para 3.20.1 for Focus Market Scheme is replaced as under:

 "An application for exports made during 2006-07 and exports made during 2007-08 shall be filed separately, with RA concerned in ANF 3D along with documents prescribed therein. E.     In Para 3.20.3, the following is added at the end.

Any one of the following documents should suffice, as a proof of landing of export consignment in specified Focus Market:

         i.            A self attested copy of import bill of entry filed by importer in specified market, or

       ii.            Delivery order issued by port authorities, or

      iii.            Arrival notice issued by goods carrier, or

     iv.            Tracking report from the goods carrier duly certified by them, evidencing arrival of export cargo to destination Focus Market, or

       v.            Lorry receipts of transportation of goods from Port into the Focus Market, or

     vi.            For Land locked Focus Market, Lorry receipts of transportation of goods from Port to Land locked Focus Market, or

    vii.            Any other documents that may satisfactory prove to RA concerned that goods have landed in / reached the Focus Market.

F.      Revised ANF 3D for Focus Market Scheme is annexed as Annexure 2 to this Public Notice.

G.    In Appendix 37D, the following is added after Sr. No G, Additional Focus Products.

HIGH-TECH PRODUCTS (PARA 3.11 OF FTP), as notified in Appendix 37E.
