The business entities need not worry about such complaints as the NAA shall adjudicate such cases only on the basis of documentary evidence and facts following principles of natural justice. The NAA noted that it is clear from the perusal of the facts of the case that there was no reduction in the rate of tax on the above products w.e.f. 01.07.2017 and hence the anti-profiteering provisions contained in Section 171 (1) of the CGST Act, 2017 are not attracted. Also, there was no increase in the per unit base price (excluding tax) of the these products and therefore, the allegation of profiteering was held to be not sustainable in terms of Section 171 of the CGST Act, 2017 . In case of infructuous complaints, a cost is imposed on the complainant. To discourage petty complaints or complaints without material evidence, complaints should be accompanied by prescribed fee.
