1915 (3) TMI 2 - HC - Indian Laws

The High Court of Calcutta ruled that a cheque given in part-payment of principal is sufficient to meet the requirements of Section 20 of the Indian Statute of Limitation. The court emphasized that the cheque, if accepted as payment, extinguishes part of the debt. Compliance with the proviso regarding the handwriting of the person making the payment was deemed satisfactory in this case. The court also rejected the argument regarding the appropriation of payment in continuous accounts. The appeal was dismissed, and costs were awarded.
