2023 (6) TMI 1451 - HC - Indian LawsDirection to consider the preliminary issue raised by the petitioner in Ext.P2 argument note, regarding the sustainability of Ext. P1 summons - HELD THAT - Taking note of the fact that the petitioner has already raised a preliminary objection by way of Ext. P2, in respect of maintainability of Ext. P1 summons, it is deemed appropriate to dispose of the writ petition directing the first respondent to consider the preliminary issue as to maintainability of Ext. P1 summons, after adverting to Ext. P2 and after affording the petitioner an opportunity of being heard, in accordance with law and as expeditiously as possible, at any rate, within a period of two weeks from the date of receipt of a certified copy of this judgment. The petition is disposed off.
The High Court of Kerala directed the first respondent to consider the petitioner's preliminary objection regarding the sustainability of the summons (Ext. P1) within two weeks. All further proceedings related to the summons are deferred until the issue is resolved.
