2023 (9) TMI 1568 - SCH - Indian LawsSeeking grant of bail - offence punishable under Section 439 of the Code of Criminal Procedure, 1973 and Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 - petitioners submitted that the petitioners have been incarcerated for a period of almost two years and the trial is not likely to be taken up for hearing in the immediate near future - HELD THAT - Taking into consideration the fact that the petitioners have been incarcerated for a period of almost two years and the trial is not likely to be taken up for hearing in the immediate near future, it is inclined to grant bail to the petitioners. The petitioners are directed to be released on bail in connection with aforesaid FIR, on such terms and conditions as may be imposed by the Trial Court. SLP disposed off.
The Supreme Court granted bail to the petitioners who were arrested in connection with FIR No. 458 of 2021 for offences under the NDPS Act. The petitioners had been in custody for almost two years with no immediate trial prospects. The State opposed bail citing statutory restrictions, but the Court considered the circumstances and granted bail with conditions imposed by the Trial Court.
