IV Dated 28-4-1993 Government of India Central Board of Excise Customs New Delhi Subject : Permission to operate empty container yards for storing empty containers imported into India with import cargo/empties without import cargo - Regarding. Reference to Board's letter Dy. No. 734/90-Cus. IV, dated 1-10-1990 on the subject noted above and to say that the question of monitoring the movement and storage of empty containers after clearance from customs in various yards for repairs or for other purposes by the steamer agents has been re-examined. It is observed that containers of durable nature when imported into India for re-export are completely exempted from payment of customs duty in terms of Notification No. 97-Cus. dated 2-5-1979 as amended subject to the conditions mentioned therein. Similar exemption is also available when empty containers are imported in terms of Notification No. 261-Cus., dated 11-10-1958. Steamer agents are accordingly executing a Bond for re-export of the containers at the point of their importation. 2. Keeping the aforesaid practice in view, it has been decided that no separate permission is required by the container yard operators for allowing storage facilities for empty containers. There is also no need for furnishing any additional Bond with the customs authorities for movement and storage of empty containers passed out of customs control in respect of which the steamer agents have executed necessary bonds in terms of the above said notifications at the time of their importation. There is also no need to obtain any concurrence of Container Corporation of India for this purpose.
