Date: 27-05-2023 PUBLIC NOTICE No. 07/2023 Sub: Guidelines for implementation of pilot project relating to import of goods for repair maintenance and re-export under ERSO Project- Reg. Attention of the Importers, Exporters, Members of Trade, Customs Brokers and all other Stake Holders is invited to Electronics Repair Services Outsourcing (ERSO) pilot project which is to be launched at Air Cargo Commissionerate, Bengaluru. 2. ERSO involves outsourcing of defective and damaged electronic items to repair service organizations in India, to repair or refurbish or re-calibrate, such defective or damaged electronic items, to bring them back to a perfect working condition. The ERSO pilot project, involving import of goods for repair maintenance and re-export, 1s proposed to be implemented in Bengaluru with an aim to facilitate speedy Customs clearance of goods imported under the ERSO project. In order to ensure smooth functioning of ERSO pilot project and expeditious clearance of goods imported for repair and thereafter re-export, the following guidelines are proposed for compliance by the following specified importers participating in the pilot. Flextronics Technologies (India) Pvt Ltd 0500076375(DTA Branch: 12,29 BWH Branch: 25,32 4 R-Logic technology Services India Pvt Ltd 0704017695 5 Lenovo India Pvt Ltd 0705001091 a) Importers should file the advance/prior Bills of Entry (BE). b) The Importers shall file the Bill of Entry with proper description of imported goods and endeavor for error free filing in order to avoid filing of application for amendment of BE. The objective should be to ensure that the need for amendments, consequent to the arrival of the goods or post examination of the cargo, is avoided/minimized as this will save time involved in the process of submitting the online application and affecting the amendments to the Bill of Entry. c) All necessary and legible documents should be uploaded in e-Sanchit to avoid queries by Customs calling for further documents during assessment and which may cause delay in the clearance of goods. d) Importers shall execute an appropriate continuity/running re-export (RE) Bond [without Bank Guarantee], which would be registered by the proper officer and the system would automatically debit the amount involved against each import. The importer would be able to check the balance of the bond amount available on ICEGATE system to decide the requirement to submit additional bond when the balance is insufficient. e) Assessment of the BEs would continue to be done by Faceless Assessment Groups (FAGs) as per the current system architecture. However, considering that all cases of repair/re-export require first check examination, the same shall be started immediately on arrival. This activity would be coordinated by the designated Nodal Officer of Bengaluru Air Cargo Commissionerate based on the advance information from the concerned importer/Customs Broker. f) A Nodal Officer in the grade of DC/AC has been nominated (para 3 below). The assessment, examination etc. including the amendment to BE, if any, will be fast- tracked by the Nodal officer and the ERSO team of Customs. g) The importers shall invariably opt for the First check with respect to the import of defective goods for repair and re-export (of second-hand goods) and it necessitates obtaining/submission of the Chartered Engineer certificate. In the interest of the importers and to minimize the cost and time involved for the examination, the examination of the goods will be conducted within the designated area of the custodian/terminal operator at Air Cargo Complex. h) For stacking/storing the subject imported goods under this Pilot project, designated area is being earmarked at the Menzies Aviation and WES Import Sheds to ensure that they are protected from the dust/moisture etc. and to facilitate expeditious examination. i) The importers are required to get the Chartered Engineer Certificate (CE) from the Empaneled list of Chartered Engineers. There are 4 Chartered Engineers who have domain expertise and are qualified for certification of the electronic items, among the empaneled CE of Bengaluru Customs Zone. Following Chartered Engineers are empaneled for the said purpose : i. Shri. Aejaz Ahmed S.T, Chartered Engineers, M/s. Value Guru Chartered Engineers and Valuers Pvt. Ltd. ii. Shri. S.Ayyappan, Chartered Engineers, M/s. Value Guru Chartered Engineers and Valuers Pvt. Ltd. iii. Shri. G.K.Rama Prasad, Prasad Associates. iv. Shri. NJ ayakumar, Skanda Engineers and Consultants. j) Movement of goods under Section 49 of Customs Act, 1962 to a Public Bonded Warehouse (PBW), for deferred examination, would be allowed, at the option of the importer, for reasons beyond their control. If desired, Importers may avail the facility of a public bonded warehouse at Cargo Village, located, within 2 km away from Air Cargo Complex, Bengaluru. 3. In order to implement the ERSO pilot project, a dedicated team of Officers headed by the Deputy/Assistant Commissioner of Customs, Shed, Airport and Air Cargo Commissionerate, Bengaluru, has been designated as the Nodal Officer, The ERSO team of Customs officers is as below : (i) Smt.
