Container delivery process for fully RMS facilitated Import Consignments - m/r - Customs - PUBLIC NOTICEExtract OFFICE OF COMMISSIONER OF CUSTOMS NEW CUSTOMS HOUSE KANDLA -370210 Phone : 02836-271468, 469 Fax No. 02836 271467 Date: 12-01-2024 DIN : 20240171ML0000111EA1 Subject : Container delivery process for fully RMS facilitated Import Consignments - m/r Attention of Importers/Exporters, Custom Brokers, Trade and all other Stakeholders is invited to Board Circular No. 19/2020 dated 13.04.2020, Board Circular No. 15/2020 dated 28.02.2020, Board Circular No. 05/2020 dated 27.01.2020, Public Notice No. 29/2018 dated 11.09.2018 Board Circular No. 29/2019-Customs dated 05.09.2019, regarding Container delivery and Custom Clearance process for Import Consignments which are fully facilitated by Risk Management System (RMS). 2. In this connection, it is informed that the importer may avail the facility of Direct Port Delivery (DPD) for the Full Container Load (FCL) containers under Bills of Entry based on the following conditions; i. The said Bill of Entry should be fully facilitated by RMS. ii. The Importer / Customs Broker (CB) desirous of availing such DPD facility shall file advance / prior Bill of Entry. iii. The Bill of Entry for commodities which does not require drawl of samples by PGAs for NOC. iv. The Bill of Entry for commodities which does not have any NCTC alert. v. The Bills of Entry which are not on hold by investigating agencies. vi. For such Bills of Entry that are fully facilitated by RMS, the Importer(s) shall discharge Custom Duty and all other dues to the relevant stake holders in advance. vii. Importer/Custom Broker availing this DPD facility shall give advance intimation to Port Authority / Terminal on their registered email IDs i.e. [email protected], and similarly the respective shipping lines, through their registered email IDs, any time before granting of Entry Inward to the vessel carrying the relevant container(s). A copy of said advance intimation shall be endorsed by the Terminal through auto email to Customs /Custom Broker / Shipping line. 3. In para 3.5 of Circular No. 14/2021-Cus dated 07.07.2021, the CBIC, in partial amendment of Circular No. 29/2019-Cus dated 05.09.2019 has conveyed that, with effect from 15.07.2021, as a general principle, all the advance bills of entry which are fully-facilitated (do not require assessment and/or examination) would be granted the facility of DPD and that such facility would be over and above the present system of entity based DPD extended to AEO clients. To take this forward, the following aspects are communicated: 3.1 The AEO clients presently registered as DPD importers shall continue to avail DPD (DPD-DPD or preferred CFS) in terms of Public Notice Nos. 29/2018 dated 11.09.2018. For AEO clients, the facility of DPD shall continue to be extended to such FCL consignments which have been either fully facilitated or not subjected to examination. 4. Further, for all non-AEO clients, as a general principle, all the advance filed and fully RMS facilitated bills of entry (for FCL containers) are hereby granted/permitted facility of DPD. No separate permission letter from Customs House, Kandla would be issued for each instance of import subject to the procedure followed here below at Sr. no. 6. 5. For the purpose of this Trade Facility Notice, the containers under Bills of Entry which are fully facilitated by RMS means where the RMS has NOT ordered / instructed / intervened / interdicted for any Assessment or Examination or both and/or for any Compulsory Compliance Requirement (CCR). Further, in these cases, there should not be any requirement for drawl of samples by PGA s for NOC, there should not be any NCTC alerts and order to hold by any investigating agencies. 6. The following procedure will be followed before allowing DPD of any FCL Container fully facilitated by RMS: 6.1 Those who are interested for availing DPD facility shall apply to The Deputy Commissioner (DPD), Customs House, Kandla for processing of their request as per details mentioned below. 6.2 The Importers who wish to avail DPD facility shall send request letter and scanned copies of the following documents with caption REQUEST FOR DPD at [email protected] (a) Request letter for availing DPD facility on the importer's letter head. (b) List of authorized signatories of the DPD importers. (c) Self-attested copies of PAN card. (Firm/ Company PAN card in the case of Partnership, Private Limited Public Limited company and Proprietor's PAN in the case of proprietorship firm). (d) Letter of authorization given to the Custom Broker attending to such imports on behalf of the importer. (e) Details of the company official with photos and signatures, in case of self-clearance 6.3 Upon scrutiny of such applications by DC (DPD), permission/ rejection will be e-mailed to registered email id of the Importer informing the basis of acceptance or rejection of the request. In case of acceptance, the letter of permission and the documents sent by the registered Importer shall be transmitted to the Port Terminals for processing of registration by Terminals and assigning of DPD code. 6.4 The other general procedures adopted for the purpose of DPD remains the same as mentioned in the Public Notice 29/2018 dated 11.09.2018. 7. For availing the facility of DPD, the Importers / Customs Brokers Shall also fulfill the criteria of Exclusion and conditions as mentioned in Para 4 of the Circular No. 29/2019 dated 05.09.2019. 8. For all purposes with respect to DPD facilitation center, DC/AC (DE) shall be DC/ AC (DPD). 9. The aforesaid measures are expected to bring immense benefits to trade industry in terms of time and cost of compliance. Further, these measures will reduce physical interface and expedite Custom clearance process making it more paperless and contactless. 10. Action to be taken in terms of decisions taken in this facility notice will be considered as Standing Order for the purpose of officers and staff. 11. Clarifications:- 11.1 Steamer Agents/ Shipping lines shall not insist/impose any extra condition on the Importer (Deposits /documents /extra DPD Charges etc.) to avail DPD facility. Steamer Agents should not charge any direct/indirect charges for moving DPD containers to Preferred CFS of the DPD importer. 11.2 Permissions from Participatory Government Agencies (PGAs) for DPD containers are to be done on priority basis. 12. Monthly reports on DPD: i. Terminal Operator shall submit a monthly report with details of DPD to Additional Commissioner/Joint Commissioner in charge of DE/DPD Facilitation Centre giving details in the prescribed proforma set out in Annexure A. ii. The Importers availing facility of DPD shall submit a monthly report through email in the Prescribed proforma set out as Annexure B. 13. This Trade facility Notice will come into effect from 15 .01.2024. 14. Any difficulties experienced in this regard may be brought to the notice of the Additional Commissioner of Custom, DE/DPD, Custom House Kandla. (M.
