Difference between “Decision” and “Opinion” - Indian Laws - GeneralExtract Difference between the Decision and Opinion Black s Law Dictionary defines a decision as a determination arrived at after consideration of facts, and in legal context, law ; An Opinion is defined from the latin word opinari which means to believe , to think . the statement by a Judge or Court of the decision reached in regard to a cause tried or argued before them, expounding the law as applied to the case, and detailing the reasons upon which the judgment is based . It explains the difference between a decision and opinion as follows: Decision is not necessarily synonymous with opinion . A decision of the court is its judgment; the opinion is the reasons given for that judgment, or the expression of the views of the Judge. This Court while considering the difference between the two expressions, namely, decision and opinion or view of law stated that, it is necessary to bear in mind that the principles in regard to the highest Court departing from its binding precedent are different from the grounds on which a final judgment between the parties can be reconsidered.
