Special Economic Zone for Biotechnology Sector in the State of Maharashtra [Village Owale, District Thane] - Area denotified - Notification Number S.O. 1606 (E) dated 2nd July, 2008 rescinded. - S.O. 4041(E) - Special Economic ZoneExtract MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) NOTIFICATION New Delhi, the 26th August, 2022 S.O. 4041(E). -WHEREAS, M/s. Mahindra Gesco Developers Limited had proposed under section 3 of the Special Economic Zones Act, 2005 (28 of 2005) , (hereinafter referred to as the said Act) to set up a sector specific Special Economic Zone for Biotechnology Sector at Village Owale (new village name Bhayanderpada), Ghodbunder Road, District Thane in the State of Maharashtra; AND, WHEREAS, the Central Government granted formal approval to M/s. Mahindra Gesco Developers Limited on 21st June, 2006. Later, the request of M/s. Mahindra Gesco Developers Limited for transfer of approval in favour of Mahindra and Mahindra Limited was approved on 19th June, 2007. Subsequently, the Central Government, in exercise of the powers conferred by sub-section (1) of section 4 of the said Act read with rule 8 of the Special Economic Zone Rules 2006 , notified an area of 22.327 hectares at above Special Economic Zone vide Ministry of Commerce and Industry Gazette Notification Number S.O. 1606 (E) dated 2nd July, 2008 ; AND, WHEREAS, M/s. Mahindra and Mahindra Limited has now proposed to of the above Special Economic Zone; AND, WHEREAS, the State Government of Maharashtra has given No Objection Certificate to the proposal vide letter No. SEZ-2006/CR-1443/Ind-2 dated 25th February, 2022. Further, the Developer vide letter dated 28th April, 2022 has clarified that they undertake that once de-notified, the land will not be developed under any residential development policy or for any non-industrial purpose, but will be used as per the applicable industrial policies of the State Government (such as Integrated Information Technology Township policy or Integrated Industrial Area policy), land use guidelines/ master plans of the State Government and applicable regulations in respect of the same. The Developer has further clarified that the use of such de-notified land will be as per the criteria set out in Instruction No. D.12/45/2009-SEZ, dated 13th September, 2013 issued by the Department of Commerce, MoC I, GoI; AND, WHEREAS, the Development Commissioner, SEEPZ Special Economic Zone has recommended the proposal for de-notification of entire area of 22.327 hectares of the Special Economic Zone; NOW, THEREFORE, in exercise of the powers conferred by first proviso to rule 8 of the Special Economic Zones Rules 2006 , the Central Government hereby rescinds the above notification except as respects things done or omitted to be done before such rescission.
