Amendments to Notification No. 33 (RE-2007)/ 2004-2009 dated 8th October, 2007 - Amendments in the ITC(HS) Classification of Export and Import Items 2004-09 - 115(RE-2009)/2004-2009 - Foreign Trade PolicyExtract Rescinded vide Notification No.117 (RE-2008)/2004-2009, dated 13/07/2009 Amendments to Notification No. 33 (RE-2007)/ 2004-2009 dated 8th October, 2007 - Amendments in the ITC(HS) Classification of Export and Import Items 2004-09 (TO BE PUBLISHED IN THE GAZETTE OF INDIA EXTRAORDINARY PART II SECTION 3, SUB SECTION (ii) GOVERNMENT OF INDIA MINISTRY OF COMMERCE INDUSTRY DEPARTMENT OF COMMERCE DIRECTORATE GENERAL OF FOREIGN TRADE NOTIFICATION NO. 115(RE-2009)/2004-2009 NEW DELHI, THE 3rd July, 2009 S.O.(E) - In exercise of the powers conferred by Section 5 read with Section 3(2) of the Foreign Trade (Development Regulation) Act, 1992 (No.22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009 , the Central Government hereby makes, with immediate effect, following amendments to Notification No.33(RE-2007)/2004-2009 dated 8th October, 2007 as amended from time to time. 2. Following shall be added at the end of Para 2 of the Notification No. 33 (RE-2007)/2004-09 dated 8.10.2007 :- "2.7 Ban on export of wheat shall not be applicable to export of wheat as following:- Tariff Item HS Code Item Description Name of PSU through which export to be made and nature of restriction 1001 Wheat and meslin 1.Export of wheat shall be limited to 3,00,000 MTs each through MMTC Ltd., PEC Ltd., and STC Ltd , respectively upto 31st March, 2010; 2. No subsidy will be given for such exports; 3. Exports shall be allowed only from Customs EDI Ports. 1001 10 Durum wheat : 1001 10 90 Other 1001 90 Other: 1001 90 20 Other wheat 1001 90 39 Other Sub-heading Note: The term "durum wheat" means wheat of the Triticum durum species and the Hybrids derived from the inter-specific crossing of Triticum durum which have the same number (28) of chromosomes as that species. 3. The quantity of wheat to be exported shall be monitored on a fortnightly basis both by the Customs Department as well as by DGCI S, through fortnightly reports to be sent to the Department of Commerce / DGFT as well as to the Department of Food Public Distribution 4. All other provisions of the Notification No.33 (RE-2007)/2004-09 dated 8th October, 2007 shall remain unchanged, and shall continue to apply. 5. This issues in public interest.
