Exemption to certain specified life-saving medicaments

In exercise of the powers conferred by Sub-rule (1) of Rule 8 of the Central Excise Rules, 1944, the Central Government hereby exempts patent or proprietary medicaments, falling under Heading No. 30.03 of the Schedule to the Central Excise Tariff Act, 1985 (5 of 1986) and containing drugs (including salts, esters and derivatives, if any), specified in the Annexure hereto appended, from the whole of the duty of excise thereon, which is specified in the said Schedule :

Provided that such medicaments may contain pharmaceutical aids (such as diluent, disintegrating agent, moistening agent, lubricant, buffering agent, stabiliser or preserver) which are therapeutically inert and do not interfere with the therapeutic or prophylactic activity of the drugs specified in the said Annexure :

2. Nothing contained in paragraph 1 shall apply to any medicament which contains any drug which is not specified in the said Annexure.

Explanation. - For the purposes of this notification, the expression "drug" shall have the same meaning assigned to it under the Drugs (Prices Control) Order, 1987.
