Amendments to Notifications No. 203/92-Cus., No. 204/92-Cus., No. 260/92-Cus., No. 299/92-Cus. and No. 101/93-Cus. Notification No. 105/94-Cus. Dated 18-3-1994 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notifications of the Government of India in the Ministry of Finance (Department of Revenue), as specified in column (2) of the Table hereunder in the manner specified in corresponding entry in column (3) of the said Table. In the said notification, - (i) the following proviso shall be added to condition (vi), namely :- "Provided that Acetic Anhydride in respect of which the benefit of this notification is claimed shall be utilised by the importer in his own factory or in the factory of any other manufacturer indicated in the said certificate even after discharge of export obligation and realisation of export proceeds;"; (ii) the following proviso shall be added to condition (vii), namely :- "Provided that benefit of this notification shall not be allowed to a transferee of licence for import of Acetic Anhydride except where the licence is endorsed for transferability before 24th November, 1993, and is transferred to an actual user who undertakes to use the Acetic Anhydride in his own factory."; (iii) in the Explanation , in clause (iii), in sub-clause (a), in the second proviso, the following shall be added at the end, namely :- "against licences issued after 24th November, 1993, except where such licences together with the quantity required for manufacture of the export product mentioned therein have been issued with the approval of Advance Licencing Committee in the office of the Director General of Foreign Trade;". 2. 204/92-Cus- toms, dated the 19th May, 1993. In the said notification, - (i) the following proviso shall be added to condition (vii), namely :- "Provided that Acetic Anhydride in respect of which the benefit of this notification is claimed shall be utilised by the importer in his own factory or in the factory of any other manufacturer indicated in the said certificate even after discharge of export obligation and realisation of export proceeds;"; (ii) the following proviso shall be added to condition (viii), namely :- "Provided that benefit of this notification shall not be allowed to a transferee of the licence for import of Acetic Anhydride except where licence is endorsed for transferability before 24th November, 1993, and is transferred to an actual user who undertakes to use the Acetic Anhydrde in his own factory."; (iii) in the Explanation , in clause (iv), in clause (a), in the proviso, the following shall be added at the end, namely :- "against licences issued after 24th November, 1993, except where such licences have been issued with the approval of Advance Licencing Committee in the office of the Director General of Foreign Trade;". 3. 260/92-Cus- toms, dated the 27th August, 1992. In the said notification, - (i) in paragraph I, in condition (5), after the second proviso, the following proviso shall be added, namely :- "Provided also that no loan, transfer, sale or disposal of Acetic Anhydride shall be made and the said Acetic Anhydride shall be utilised by the importer in his own factory or in the factory of any other manufacturer, as approved by the Licencing Authority;"; (ii) in paragraph 2, after the proviso, the following proviso shall be inserted, namely :- "Provided further that benefit of this notification shall not be allowed to a transferee of licence for import of Acetic Anhydride except where the licence is endorsed for transferability before 24th November, 1993, and is transferred to an actual user who undertakes to use the Acetic Anhydride in his own factory."; (iii) in the Explanation , in clause (iii), in sub-clause (a), in the proviso, the following shall be added at the end, namely :- "against licences issued after 24th November, 1993, except where such licences have been issued with the approval of Advance Licencing Committee in the office of the Director General of Foreign Trade;". 4. 299/92-Cus- toms, dated the 30th November, 1992. In the said notification, - (i) in condition (vi), after the proviso, the following proviso shall be inserted, namely :- "Provided further that Acetic Anhydride in respect of which the benefit of this notification is claimed shall be utilised by the importer in his own factory or in the factory of any other manufacturer indicated in the said pass book even after discharge of export obligation and realisation of export proceeds."; (ii) in the Explanation , in clause (iii), in sub-clause (a), in the proviso, the following shall be added at the end, namely :- "against pass books issued after 24th November, 1993, except where such pass books together with the quantity required for manufacture of the export product mentioned therein have been issued with the approval of Advance Licencing Committee in the office of the Director General of Foreign Trade;". 5. 101/93-Cus- toms, dated the 16th March, 1993. In the said notification, - (i) in paragraph 1, in condition (6), after the second proviso, the following proviso shall be inserted, namely :- "Provided also that no loan, transfer, sale or disposal of Acetic Anhydride shall be made and the same shall be utilised by the importer in his own factory or in the factory of any other manufacturer as approved by the Licencing Authority."; (ii) in paragraph 2, after the proviso, the following proviso shall be inserted, namely :- "Provided further that benefit of this notification shall not be allowed to a transferee of licence for import of Acetic Anhydride except where the licence is endorsed for transferability before 24th November, 1993, and is transferred to an actual user who undertakes to use the Acetic Anhydride in his own factory."; (iii) in the Explanation , in clause (iii), in sub-clause (a), in the proviso, the following shall be added at the end, namely :- "against licence issued after 24th November, 1993, except where such licences have been issued with the approval of Advance Licencing Committee in the office of the Director General of Foreign Trade;".
